Hi Everyone,

I am somewhat new to the forum, and more of a reader than a poster (1st post) but I was hoping to get some feedback on my situation. Thanks so much in advance.

Here is the timeline I have as of now:

Medical done on: 8/6/2012
App sent: 8/31/2012
App received: 9/4/2012
Sponsorship appr: 10/22/2012
Medical received: Noted as Received on CIC website with no date
Request for Documents and Passport Copies: 2/21/2013
Documents and Passports sent: 3/1/2013
CIC Website “We started processing your application on”: 3/4/2013

I apologize for all the questions, but I have a few:
1) Does the 3/4/2013 date mean that we have roughly the 13 months that is currently stated for the Ottawa CPP for Processing Time?
2) Based on the below:
- Intent proven by signing a rental lease starting 6/15/2013 (My wife will relocate in June regardless of my status to prove intent), letters from family, accountant and realtor, stating they knew of our intent for the past 24+ months. I am now concerned that I have another 13 months so my wife and I will be living separately for nearly a year. Do you think that is the case?
- My wife recently changed her last name to my name (long story) but in doing so she realized that her Canadian passport had expired (2 months ago). Unfortunately we sent a copy of this expired passport to CIC. Do you think that will be an issue?


Below is the email we received as the "Request for Documents and Passport Copies":
This is in reference to your application for permanent residence in Canada as a member of the family class. We have now completed the initial assessment of your application, and expect to finalize your application without a personal interview. While an interview does not appear necessary at this time, we reserve the right to call you to an interview, should this become necessary at some future stage in processing.

PLEASE READ CAREFULLY ALL OF THE FOLLOWING INFORMATION BEFORE PROCEEDING FURTHER. YOUR APPLICATION WILL BE FINALIZED BY THE CASE PROCESSING PILOT – OTTAWA (“CPP-O”).

Ø In order to continue processing your application, the following is required:
Paragraph 130(1)(b) states that, subject to subsections (2) and (3), a sponsor, for the purpose of sponsoring a foreign national who makes an application for a permanent resident visa as a member of the family class must be a Canadian citizen or permanent resident who resides in Canada.

Based on the information you have provided, I am not satisfied that your sponsor resides in Canada from the day on which the application was filed up to now. Specifically, I am not satisfied that you, the sponsor, are currently living in Canada. Accordingly you may not meet the requirements of paragraph 130(1)(b) and section 120 of the Regulations.

Provide Proof your sponsor, resides in Canada. If she does not reside in Canada, please request your sponsor to prove his intent to reside in Canada.

Ø COPY OR SCANNED IMAGE of your passport and passports of your accompanying family members, as noted below.

Passport Copies:
You are a citizen of a country that is exempted from obtaining a visa to visit Canada under Regulation 190 of the Immigration and Refugee Protection Regulations. You are therefore required to send only a copy or scanned image of the photo page of your passport and of any pages indicating a validity extension or change to your personal information. You must submit these copies/scans for yourself and for all your accompanying family member(s). DO NOT SEND YOUR ORIGINAL PASSPORT(S). We require copies of a VALID passport for yourself and every accompanying family member. Please note that permanent resident visas cannot be issued on Diplomatic, Official or Military passports.

Hello! I cannot answer all of your questions, but I can answer a few. Forgive me if I give you incorrect information, but this is the best knowledge I have and I'm pretty confident in it. I'm sure that others will help you also.

What you received was your PPR e-mail. Like it says, since you are from a visa exempt country you do not need to send in your actual passport. I do not believe that you're going to have to wait 13 months for your COPR. That usually only takes a few weeks. Remember, you're not waiting for your whole application to be processed, you're just waiting for it to be 'finalized'. The bulk of your wait is over.

I think that you proof of intent is crystal clear and there won't be a problem, so dont' worry about that!

As far as the passport is concerned, that shouldn't be a problem either. A few months after my application was sent I lost my passport and had to apply for a new one. The one I will be sending them a copy of will be different than the one I sent original, and the agent I spoke to on the phone said that it would be OKAY.

It's irritating, but I think the evidence you're providing ought to be plenty. We just mailed our response yesterday (about 60 pages of email correspondence about our move, with potential employers, about selling our house, etc.), so I guess we'll know in 2-8 weeks whether we've successfully proved my intent to move to Canada.

The irony is that first they ask you to prove your relationship is genuine, and then they can't figure out why one half of that genuine relationship hasn't yet moved to Canada six months after applying, when they tell you the process takes 13 months.

Exactly!! Why if our relationship is genuine would we want to live apart at all?! It makes no sense! Regardless of what happens my wife is moving on 6/15, so I hope our signed lease is enough and they dont actually need her to move.

I got an e-mail almost identical to yours, except they asked for passport copy, CSQ (which Quebec was supposed to send), and the RPR fee. I'll be sending the Passport and the CSQ on monday, but will be waiting for pay the RPR fee until the end of March. I expect to have my COPR before May.

I'm going to guess that Ottawa has a special circular file where they put all the CSQs. For what it's worth, I sent copies of the CSQs that were sent to my family because a) Ottawa didn't demand originals and b) the letter accompanying the CSQs said to hang on to the originals.

2 Questions:

Does it do any good to dispute the FBI clearance? I have proof they rec'd it prior to the expiry date. Proof being it was signed for in Ottawa about 10 days before it expired. WHY do we only get 60 days when the FBI states "processing times may take approximately five to six weeks depending on the volume of requests received." Gee, that gives me about the SAME amount of time to get CIC what I did before!

When IMM5406 asks for Changes to your Family Composition:
· Have you married or divorced?
· Have you given birth or adopted a child?
· Do you intend to get married or divorced prior to becoming a permanent resident?
· Do you intend to give birth or adopt a child prior to becoming a permanent resident?
· Has your sponsor withdrawn his or her sponsorship of your application?

If any of these conditions apply, you must inform CPP-O immediately. You will be asked to submit evidence such as a copy of the marriage, divorce, birth or adoption certificate or a letter advising when and where the marriage, divorce, birth or adoption is expected to take place. Any new spouse and/or children must be added to your application and be found admissible to Canada before your case is finalized. Failure to declare additional dependants such as a spouse or children before you become a permanent resident could result in the cancellation of your permanent resident visa.

I didn't let them know we got married, they found out when I sent the marriage certificate, with my application!

So, I have to send the marriage certificate again? AND put my Canadian hubby and step-daughter on IMM5406? They're not "accompanying" , they're Canadian citizens!

I'm so confused.

I went to the local MP and their office faxed the email and the IMM5406 to their Ottawa office, saying I'd already sent the FBI clearance and passport to them and asking if the only requirement is the IMM5406. Stopped by later and MP's sec'y said the MP's asst from Ottawa thinks I only need to send in the IMM5406. I get a check in my spirit about it. They may be politicians, but they're not immigration specialist. Anyone have advice?

re-re-re-RE reading the email, it lists 3 things they want and there's nothing about "if you've already sent the items, please dis-regard" kind of thing. AND it all has to be mailed together. If the FBI is taking 5 wks to get to the fingerprints, OMG, that 60 days is cutting it close!

On a POSITIVE note: I FINALLY noticed in the email (I've been somewhat traumatized by it LOL) that they expect to FINALIZE (emphasis mine) my application without an interview!

Just out of curiosity, does anyone know if there is a timeframe from when you receive your COPR to when you have to enter Canada as an outland? I am just being overly positive maybe, but if I get it in mid April 2013, do you think it would be ok to not go to Canada until mid June 2013?

I'm sorry! I didn't even see your questions!

You do have to send all of the information you ask whether or not you already sent it or not. I think it's just safe to assume that. Technically they already have a copy of my passport and the CSQ, but they asked me for it. Put an Immigration deadline on your request and just take deep breaths! It only took me a month to get mine back when I put a deadline.

If they have never been sent a copy of your marriage certificate, you need to send that as well. The good news is that it's a copy and you won't have to get another original copy.

You DO NOT have to include your hubby or daughter on the forum though. By 'accompanying' they mean to Canada as a new Resident, not on the flight or in the car when you cross the border.

You need to land before your medical expires.
