I don't have status in Canada, I'm planning to apply for Federal Skilled Worker program under Canada’s Express Entry system and wondering if I can include my partner under common law partner together with our son on my application if I am still legally married. Thank you

In principle yes. You'd best post in the forum related to the program you wish to apply under. This is the family sponsorship forum, where citizens and permanent residents sponsor family members.
