Separated from wife but no divorce. CIC asked for divorce certificate. What should I do?

Hello Group members,

I am separated from my ex from 2017 and the case is still pending in Indian Court (As my ex is not very cooperative with the case + COVID situation).
Now, my PR is having all stages passed except Officer keep asking me for Divorce Certificate.

I have already provided Case Status (With Certified Court Proceedings), a Letter from my Lawyer, Affidavit from my end that I will never sponsor her in the future and there is no chance of reconsilation. But Officer is asked me the same for the fourth time.

In the first letter, the officer gave me 7 days to reply. (Eligibility, Medical, BG + Criminality All passed here)
In the second letter, the officer asked me to submit the case status after the next hearing date which was after 1 and half months.
After two months another letter asking Divorce Certificate or Explanation if not available (7 days). I replied on the same date as there was nothing new in the case.
The next day, another letter asking Divorce Application, Divorce Certificate, and Divorce Order with 2 months of the date.


Please suggest to me, what can I do.

Hey! I have received my PR in July 2021. The officer was confused (Yes! They can get confused with the information we are providing) with my marital status which was "Legally Separated" and not "Divorced". I just wrote a letter explaining the same in two lines.

Hi , Can you please specify what you wrote the visa officer, which made him to understand your situation. Can you please post here? it would be a lifesaving help me and many others?

I am in the same boat too. Separated from my wife (and daughter who stays with my wife in India) and I moved to Canada after separation. Got my PNP and my PR has been in process with IRCC. Most of my processing was done including medicals but IRCC sent letters for medicals and other documentation for my wife also as I am still "legally married". I had provided divorce file number earlier but there is no much progress for the case due to Covid and apparently multiple files in queue in the court. Now one immigration consultant suggested to send affidavit signed by a notary but I am still hesitant as I am still trying for reconciliation with my wife because of my daughter. I am worried that it may completely block if I submit the affidavit for my wife's PR in future in case if she reconciles also.
Can anyone please help to clarify the following?
1. Is there any way to sponsor my wife in life time if she reconciles in future after I submit the affidavit, like remarrying etc.?
2. Does it really help to get the PR with the affidavit for this kind of cases? Did anyone get the PR (those who posted here or any other people who see this forum)?

Your response will be really helpful for my decision. Thanks in advance!

were you able to sponsor your wife or got your PR as legally separated without affidavit?

No, I didn't get it yet. I think it's on hold due to my marital issue though they didn't explicitly stated so far. It shows it's still in progress.

I myself is in the same situation, did you submit the affidavit that you are aware you will never be able to sponsor your wife again to Canada or did you guys reconciled and applied together?

1. Is there any way to sponsor my wife in life time if she reconciles in future after I submit the affidavit, like remarrying etc.?
2. Does it really help to get the PR with the affidavit for this kind of cases? Did anyone get the PR (those who posted here or any other people who see this forum)?

I want to bring my family in future though my wife is not cooperating at this time. So I am hesitant to take this step of providing the affidavit unless there is a remedy. Please anybody answer if you know the answer.
