Hi,

My husband (who is UK) and I are applying for family visa, spouse - inland.

We have all of the documents, expect the US police check. My husband has lived in the UK for all of his life except for 2 year period in the US - thus requiring the US police check. Based on their timelines, it may take another 8 weeks before we receive (hopefully we'll receive it), which would potentially null the UK police check that we do have.

Based on another immigration website, it noted that you should proceed with your application if that is the only outstanding item, and forward once Immigration Canada request it. However, I just wanted to see if others had done this, and faced issues, including their file being rejected, which obviously would be a nightmare.

yes, this is quite typical right now because of how long it takes to get an FBI record. it will be requested after sponsor approval, and you'll be given instructions on where to send it once the file is transferred.
 
I only sent my application in at the end of January, but I sent it without the FBI check as well. I included a formal letter explaining the situation (which I'm pretty sure they are aware of by now) and told them I'd send it asap. I didn't have any sort of receipt showing I had applied, so I just sent a copy of the form I sent to the FBI. I'm hoping it will be ok. I had everything all ready to go and didn't want to wait another month or two (sent off for FBI check last November). :p
 
Ms_Tiff, sorry for changing the subject , but i noticed you said you're going to file an Inland application for your UK husband .. i just wanna make sure you know that your husband won't allowed to leave Canada during the process and it takes a lot of time, around 2 years from what i've seen from recent timelines (keeps going up, the backlog is fantastic for inland apps).
better file an outland application and you'll be done in around ~ 1 year, processing time for London is 11 months i believe. i want to add that your husband can still stay with you in Canada during the process since he's from a visa-exempted country (6 months maximum - but he can obviously apply for an extension and stay even more afterwards).
 
Oh, I didn't notice the 'inland' part! Yes, do file outland instead. It will be much faster and more convenient for both of you!
