Hello everyone,

I am currently facing a challenging situation and would greatly appreciate any guidance or advice.

My Permanent Residence (PR) application under the Atlantic Immigration Program (AIP) is in process, and I have already completed my biometrics. Recently, I applied for an extension of my work permit under the AIP stream, but unfortunately, it was refused. As a result, I lost my job because I no longer have status in Canada.

I have since reapplied for a work permit extension, but until a decision is made, I cannot legally work.

In the meantime, I would like to know:

Am I eligible for Employment Insurance (EI) benefits under these circumstances?
If yes, what steps do I need to take to apply and receive these benefits?
I understand that EI typically supports individuals who have lost their jobs through no fault of their own, but I am unsure how my current situation with my work permit status might impact my eligibility.

Unfortunately you don't qualify for EI. You must be holding a valid work permit to qualify and losing a job due to work permit expiry / refusal isn't ground for applying for EI.

Just to clarify, I assume you have also applied for restoration.

If your status is restored it will be to visitor so the new WP extension is pointless and will also get denied.

But I am reapplying for the work permit extension to the same application that was refused, so I will be back on work permit. I dont understand how it will be pointless could you please shed some light on it for my better understanding.

OP is restoring status back to work permit not visitor.

What is the reason for the refusal ?

You don’t qualify

Here are some questions you might be asked when completing an Employment Insurance (EI) report:
  • Were you outside of Canada? If you were, answer "Yes" and provide the departure and return dates and times, and the reason for your absence

  • Did you work?If you did, answer "Yes" and provide the total hours and dates worked, the name and address of your employer, and your total earnings before deductions

    • Did you start a new job?If you did, answer "Yes" and provide the date the job started
    • Did you attend school or training? If you did, provide the total number of hours and any training allowance you received
    • Were you available for work?Indicate whether you were available for work
    • Did you receive other money? If you did, report it, even if you'll receive it later
Were you available for work ?

No

I was available for work but was terminated due to the work permit extension refusal and did not receive the update on the PR application except biometrics. I am in Canada since I left my job.
I cannot work anywhere due to the the Work permit refusal and that is why I am looking for EI support my last day of work was 6 th December and I did not receive anything except my last pay.

Unfortunately availability to work includes the requirement of holding a valid work permit. Since you don't hold a valid work permit at this time, EI is not possible.

“ I was available to work “

But you aren’t now available to work . Being available to work, while on EI is mandatory
If you don’t have a work permit then you aren’t available to work
