I think you should cut your losses now. As everyone has stated it will be a very long and difficult process and most likely will have a negative outcome at which point youll be forced to make the decision that you should make now. Run away from the man or move to india. This is NOT a good situation. Period.

No one who is scammed in marriage believes it.

Had you actually met and had a proper relationship, you MAY have had a chance at successfully sponsoring him. However, with his history of marriage fraud and this being an arranged marriage where you haven't even met, I'd say chances are pretty much zero.
 
So, you have never met this person.... he commited immigration fraud in another country, (and has convinced you, not anyone else that he had no knowledge of it), divorced a woman who has had his child in a culture that is not well known for getting divorced, and you really think that there is not going to be any issues? I honestly think if you are wanting to do this, you should get ready for all your appeal information at the same time. You're going to need it. Take a look at the canlii website and look up some refusal cases. There are tons like yours. And they dont get thru the appeal process.

You can certainly try. But again, given his history, you should expect this will not be a straight-forward application.

I assume you plan to travel to India and get married there?
 
Is family sponsorship the only way for him to get PR status? Did he consider other programs? Let him apply for PR himself and when he is in Canada (legally, with PR status received because of his skills) you can marry him and be sure that he marries you because he loves you and not because you can get him PR status.
 
Try telling him that you can't sponsor him to Canada but you will move to India so you can be together as a family. See if he still wants to marry you then. (Although I kind of think he's going to have a change of heart)

Before even starting to look for a lawyer you should test him as adviced before to make sure you’re not a victim of marriage of convenience.
 
Case 1) Sponsor was caught in MOC in the past, their appeal is denied even though she and the applicant has a child together.

She has a child that she can't take out of Canada so leaving to go live with him isn't an option.
