@ LINE,
sorry for answering to your PN on the thread but for some reason I am not allowed to send personal messages and I can't figure out how to change this. I cannot find any setting for this in my profile.
What do you mean by you were given limited stay? As a tourist? Isn't this always the case no matter how often they let you in? Or did they give you like explicitly only 3 months and not a day more for example?
We are kind of in the same situation and at the same time we are not. As I understand from your post/PN you where literally traveling back and forth between C and DK? Whereas I only left C once since I came here and always extended my stay from within C.
But like you I was told that this is not a long-term solution and that I should figure out something else and that I might get refused the next time traveling to Canada as a tourist.
That's why I came up with the IEC for a solution. I also applied from within C (I understand you did the same thing), sent my application to Germany and got my LOI by email. I will leave C in march and come back in April. So, as for your question on how I managed to get back in with the IEC visa: I haven't tried yet and I will see what happens. Anyways we have no other choice right?
I am also very scared that for some reason they won't let me back in. Especially, since I run the risk of "losing my son" over this. But in moments like this I just try to reason myself. I did nothing illegal. I have never overstayed, I always extended my tourist visa in time, I have always been honest about the reasons for the extension. Also, within my IEC application I mentioned and proved the fact that I have a son and a common-law partner in C. So, what I am trying to say is that THEY have always been aware of my situation, THEY always decided to extend my stay, let me back in, give me the IEC visa, THEY told me to find another solution (what I did). The fact of being a visitor to C for more than the usual 6 months, extending your stay, going back and forth may not please them, but it is not against the rules, otherwise this option wouldn't exist. At least, it is your right until the day they will refuse you entry or extension. If they really think you have been visiting too much they wouldn't have let you in the last time. It is also your right to apply for a work permit under the IEC (or else) after being a tourist. Of course, it will be the customs officer at the boarder who will have the last say in this matter, but he will rely on the fact that you have been granted the IEC visa for a good reason. And he knows that the IEC department certainly did a background check on you and was well aware of your situation.
I know this is not much of a help but there is nothing you can do about it right now. You did all you can, you are in your rights, you did nothing wrong, there is no apparent reason for refusing you at the boarder. Just keep this in mind and play it like "Here I am, I came up with a solution for my situation".
Honestly, I don't know what to advise you. So far, I am the one playing it 8) , but I think by April I will be as scared as you are right now. All I can do is wish you all the best and that everything goes well. Keep us posted.
