Salary raise before/during the PR

hi all,
I'm currently here in Canada with a TWP.
Last year my employer promoted me and they gave me a salary raise of 20%.

All good and happy, but to be fair I just realized that for what I am doing, and for the title I have, I am still quite fairly underpaid.
I mentioned this to my employer who doesn't deny it at all and is currently making promises.

They have recently came back saying that HR said that a potential further salary increase could unlock a potential issue with my current immigration status because it seems relevant that my original status doesn't match with who I am or what I have became.
They also mentioned that a potential salary should go through another LMIA or other autorization.

I don't know if this is truth or not (and to which extent eventually).
All I know is that I have potentially 2 other employers ready to go through all the immigration procedures with me. And they would pay me way more.
There for I don't know exactly what to do.
Especially since I am in the middle of the PR as I am writing, but it could take still a couple of months.


So the question is: is it truth that too large promotions and salary raise could be an issue ? and if yes how extended this is from the original initial salary ?

Is TWP means temporary work permit?

If you are applying with LMIA and have closed work permit then you might need to stick with that until you will get your PR as its more complicated.

If you are on Open work permit like PGWP then no need to worry about. you can change your job after EAPR. I did it.

yes Temporary Work Permit from an Intra Company Transfer; and no, I cannot change employee as of now, because my TWP is linked to my employee.

Why would they give me a salary increase if I cannot leave them anyway ?

Because they value me, and they know that the second I would get the PR I would leave immediately.
So they will eventually raise my salary for sure once I will get the PR, but now they are saying they cannot because of some NOC potential issues.

And if you are wondering why should I bother now instead of waiting 2/3 months that will not change my life...
The reason is that decision on salary increase are usually taken in June to be effective July 1st.
(not to mention I have another offer ready with a LMIA ready new employee that is way higher than my salary now).

Hi,

I understand you are currently working basis closed work permit as Intra-Company-Transferee (assume LMIA-exempted). Here the company and you are free to agree on a salary level (since you already obtained your closed Work Permit). Now, I am not sure if your current PR application is based on LMIA processed by your current employer? The date the company / you obtained the positive LMIA you are bound to the conditions as set out in the LMIA and the salary can not deviate up/down until obtaining PR status.

If there are no LMIA conditions to be considered then you / the company can play with the salary as much as you want only that the hourly rate should NOT go under the minimum wage for your NOC in your province.

Hello! My husband's employer just told him that he is giving him a raise (but still the same position). This is after my husband received a nomination via RNIP. Planning to lodge PR app next month. Should my husband ask for a new job offer reflecting his new salary? Would there be no problem since the job offer he submitted for nomination is different from what will be submitted in the PR application?

No, Promotions (salary or position) don't impact application. Increase in Salary is a good thing to make your case more stronger.
When you submit your application just include promotion letter, if you don't have promotion letter then you can ask the HR to issue employment letter with updated salary with that you can attach letter of explanation explaining that you got promoted recently.
