Five months after Manjit Shahi arrived in Canada and allegedly abandoned his new bride, reigniting a maelstrom about fraudulent marriages, he has voluntarily returned to India.

“I am the victim, not her, but because she’s in a wheelchair, she got all the sympathy,” Shahi said by phone from Ludhiana, an industrial city in northern India.

“I was never given a chance to tell my side of the story,” he said.

The couple’s story, which has more twists and turns than a Bollywood tear-jerker, started in 2006 when Shahi, who then lived in England, met Brampton’s Ashpreet Badwal online. In late 2007, Badwal travelled to India; they married.

Badwal is 35, five years older than Shahi, has polio and needs a wheelchair.

Badwal returned to Canada and filed an application to sponsor her husband in March 2008. In December, the application was rejected because of the age difference and compatibility issues, Badwal told the Star. She hired a Bay Street law firm to fight her case and won on appeal.

On June 26, Shahi got his Canadian visa. Two days later, he was on a British Airways flight to Toronto. But Badwal says she never saw him and he fled from the airport.

Fraudulent marriages are not a new phenomenon in the South Asian community; dozens of cases are reported every year where people get married so they can immigrate to Canada, and once here abandon their spouses.

But this case hit a nerve because Badwal uses a wheelchair. She spent thousands of dollars appealing an earlier Citizenship and Immigration decision rejecting her application to sponsor Shahi.

In the ensuing furor in the community, Shahi says nobody cared for his side of the story.

“She never told me she had polio or that she was five years older,” said Shahi, adding that Badwal sent “glamorous photos of herself.”

He says he realized that she had polio on the day of the wedding. “I couldn’t have walked out on her . . . I quietly married her and we later had a chat,” he said.

Shahi, his voice choking, said Badwal told him they should stay married so he could come to Canada. “She said I could do anything once I got there,” he said. “We weren’t even supposed to meet at the airport that day.”

That’s all untrue, says Badwal.

“He always knew that I had polio . . . and there was no such pact,” she said angrily. “He used me to come to Canada and because it didn’t go the way he had expected, he’s now saying all these things.”

Shahi, meanwhile, says he opted not to stay in Canada after all this bitterness.

Initially, he hired an immigration lawyer to fight his case and even went for a half-dozen interviews with agents of Canadian Border Services Agency. To be deported, he would have had a hearing with the Immigration and Refugee Board. If ordered to leave the country, he would have had the right the appeal.

Shahi says he wasn’t up for all that, especially since he didn’t have much money to pay his lawyer and was couch-surfing or sleeping in a car.

He surrendered his Permanent Resident card and on early Wednesday morning boarded an Air India flight to New Delhi.

“I want to close this chapter in my life,” he said. “I don’t know what I am going to do, even where I’m going to live but anything will be better than what I went through.”

so true ... i was thinking the same thing.... just because of some fake and fraud people all have to suffer....**sigh** :-[

something sounds fishy in the whole deal.
he used her.
then he got caught.
and he left.
now he has this big stain on his name.
and he wants to clear it because he probably can't even get a job.

It's always dangerous to make assumptions based on a newspaper story with two completely different sides. Whatever really happened (if we disregard what they thought the other person knew or not) will always be mystery, so let's not assume to much.

... at most that it could only tighten the marriage fraud legislation.

Both sides of the story end up being marriage fraud. Either he used an innocent woman to come to Canada (her story), or she tricked him and then the two of them agreed to pretend to have a genuine marriage so he could come to Canada (his story). In both cases there is no reason whatsoever why he should be allowed to stay in Canada; he said he didn't fight to stay in Canada because he didn't have the money, but there is no way he should have won in any case.

Interesting, CIC refused saying it was a MOC, appellant appealed, won claiming it wasn't, and now we find out that CIC was right in the first place.

This article just upsets me to even see that people still lie their way into Canada. I don't even know who to believe in the article anymore.

This is way much more complicated than a Bollywood drama. I bet at some point it will turn into a Bollywood movie and hopefully one day when I watch that movie it will click to a true life story I have read or heard somewhere. LOL.

You have a choice to open the thread and read what's written in it or ignore it and move on. Beside too, it's an article about current issues surrounding immigration fraud and raise awareness as to what is ideally happening out there.

Most people in this forum have met their spouses through some sort of online medium which may fully well help them determine whether or not the person they are talking to online is in a rship just to acquire a golden ticket into Canada or to spend the rest of their lives together until death do them part.

The problem is that ignoring the fact that this took place (as you suggest) does not make it go away.
The difficulties that genuine couples suffer because of cases like this are very real, being aware of what can happen and understanding as much as we can is a good thing.

I have been visiting Canada for many years, the public perception of this immigration "issue" is growing and that will directly impact immigration law.
it takes time, but it will mean changes occur. I am pretty certain that the changes are not likely to make immigrants lives easier.

Obviously there are many applications that pass quite easily, I am happy for them.
In other cases, I am sure that if people were given the "real deal" about the financial / emotional cost, relationship difficulties, the hassle, feelings of helplessness, the wasted time and many other problems that they are likely to face; no doubt people would choose a different path, maybe choosing to be together elsewhere, maybe other options. You only have to read some of the posts on this site to see that life is not easy.

Moving to Canada is not about a "dream", people use that term, but I think it is too nebulous.
Immigrating (and integrating) to Canada is about hard work, commitment and a lot of pain to realize a future for yourself and the person / people you love.

For me, anyone who wants to cheat or deceive the system needs to be refused entry for life or deported, forever.

I just wish media would post more of the good stories, the successful stories too.
But understandably the media goes on drama but they don't realize just how much they are hurting us. They seem to treat the family class as if ALL marriages aren't genuine, that is what gets me mad. It is valuable in my opinion to hear both good and bad in order to get a better understanding, however, I don't see that happening anytime soon.

All in all, glad he owned up and did the proper thing which was surrendering his PR rights and card. Too bad others won't do this. I feel if they are found in court to have committed marriage fraud and there is undying proof of it then if found guilty they should HAVE to leave immediately and surrender all PR rights. They committed a crime and don't deserve to form a life here based on a lie. All of us end up suffering because of it.

There are million cases better than this case, I know many people have been sponsor from their spouse and they are living good, but media like this kind of action, need people to watch more about this kind of story.

It is not system fault if she cannot know he was used her, if she could not know how would CIC officer now about it, plus CIC officer refused the case at the beginning.

What is sad here, there many cases will damage under fear of this story will come up again. the CIC officer will think many times before he give approve for anyone, if I am in their shoes I would have act the same.

This guy from India he is truly lair, from fact if you read the story or watched, why she would have paid all the money for him, simply she wanted to be with him, she find he could be her dream, someone who would really spend her life with him, but he was not.

she should know him more and better, before she sponsor him, yes she should. there are million ways to know, and simply but as they said love some times blind

I am happy he backs home, and anyone act same I would be happy seen him back too.

I am not promoting. I am simply highlighting a case that has been ongoing in the canadian media which caused a negative impact on foreign spousal applications. You need to connect the dots between these cases and the government's initatives that has been happening recently.
