I know I'm repeating stuff from previous messages but I'm also with the same problem about not meeting the 2 year residency requirement. My PR card will expire on 21 Dec 2010. I have lived in Canada for 1 year 3 months and left Canada at the end of March 2007 (which means that my 3 year permitted stay out of Canada is almost up). Unfortunately, the earliest I can re-enter Canada is late May 2010, this will lead to the failure to comply with the 730 day rule (short about 60 days). These are my concerns:
(1) If I managed to pass through immigration, how long should I wait until I re-apply for the PR card renewal? If I get back on late May 2010 to the date of expiry on 21 Dec 2010, it would be a continual stay of only 7 months (plus my previous stay of 1 yr 3 months would be a total of 1 yr 10 months--hence short 2 months). My question is should I wait another 2 months and apply around March 2011 or wait even longer to accumulate a 2 year stay of my latest re-entry (that means re-apply in May 2012)? I apologise for the long winded explanation.
(2) The other problem is being questioned by the immigration office upon landing. If I return on late May 2010 with my PR card going to expire on 21 Dec 2010, there most likely be a high possibility that I will be stopped and questioned--then the game is up right? Is it true that coming into Canada via USA by car would increase my chances of 'escape'??
(3) Last question is can I re-apply for a new PR even before the present PR card expiress (not a renewal but a new application) or do I have to wait until ther present card expires and then start the re-application process again after 21 Dec 2010??
