I know I'm repeating stuff from previous messages but I'm also with the same problem about not meeting the 2 year residency requirement. My PR card will expire on 21 Dec 2010. I have lived in Canada for 1 year 3 months and left Canada at the end of March 2007 (which means that my 3 year permitted stay out of Canada is almost up). Unfortunately, the earliest I can re-enter Canada is late May 2010, this will lead to the failure to comply with the 730 day rule (short about 60 days). These are my concerns:

(1) If I managed to pass through immigration, how long should I wait until I re-apply for the PR card renewal? If I get back on late May 2010 to the date of expiry on 21 Dec 2010, it would be a continual stay of only 7 months (plus my previous stay of 1 yr 3 months would be a total of 1 yr 10 months--hence short 2 months). My question is should I wait another 2 months and apply around March 2011 or wait even longer to accumulate a 2 year stay of my latest re-entry (that means re-apply in May 2012)? I apologise for the long winded explanation.


(2) The other problem is being questioned by the immigration office upon landing. If I return on late May 2010 with my PR card going to expire on 21 Dec 2010, there most likely be a high possibility that I will be stopped and questioned--then the game is up right? Is it true that coming into Canada via USA by car would increase my chances of 'escape'??

(3) Last question is can I re-apply for a new PR even before the present PR card expiress (not a renewal but a new application) or do I have to wait until ther present card expires and then start the re-application process again after 21 Dec 2010??

Flim, I tried to reply to your message but your inbox is full now.

When you arrive in Canada and do not meet the residency requirements, it doesn't mean they will take your card away because they may not know how long you were gone. They will ask you though. The problem is if you lie to immigration and they find out, you would be in trouble. Have you visited Canada in the meantime? They would not know if you have a 1 way plane ticket.

Another thing you can do is renew your passport, even if it isn't expired so you will show up with a new passport with no stamps in it. They may scan your PR card and possibly they will have in their computers dates that you have entered Canada but they will not be able to see the dates you left Canada since that isn't scanned and your passport would not have any entry stamps from other countries. It's possible that they could have access to that information with their sharing with other countries but I don't think it's something they have direct access to, more like something they could check if they really wanted to.

What informationS are asked in the PR renewal form.it is just self declaration or any proof they asked to attach.But i think no proof is required to be enclosed.

Yes I too heard about passport renewal for not disclsoing the travel dates.wii it work?
 
The PR renewal form is a self declaration but you don't know what they know. They certainly would have all dates you have entered Canada, even if you have changed your passport because they have your old passport number since you gave it to them when you applied for PR. They could use that to check up on you with border services in other countries they work with such as the US. If you lie and get caught, you could be in big trouble and lose your PR.

Getting a new passport could help you get in to Canada without many questions but do not count on it to help you lie to immigration. If you get in, sit tight and wait your 730 days before you apply for a new PR card. If you do that, you will truly meet the residency requirements again and there is nothing they can say to you.

The information is so helpful and even some one thinks to meet PR obligation some way will not involve in such activites.Also I wonder so many people get into canada and dont want meet PR obligation but interested in keeping the PR status.even take my case I got my PR at the age of forty six,i found it diffcuilt to get a suitable job to my age and profiel.same as the case in my wife.I undersatnd immediately getting into business also not advisable without canadian experience.I decided to be in canada for about four to six months or more in every year to meet the residency obligation.for whcih i need your opnion on the following.

1.can I and mywife get any job for six months in a year.any reference or idea please share.
2.we are in Toronto,we need an accomadation for 500 $.presently paying 800$.

The idea is to keep PR status ,then when possible settling there.
 
You can always get some kind of job if you want to work. Survival job. I have met people in Alberta who were an older couple from Newfoundland. They had a boat but fishing is only for a part of the year so for the other part of the year, they came to Alberta to work as industrial helpers, sweeping the floor, doing other simple tasks, whatever it takes.

Toronto may not be the best city to do this. Look up the unemployment rates, look up housing ads, then visit some cities and see how you like them. I think it will be hard to find accommodation for $500 in any major city unless you are just renting a room. Possibly you can find a small bachelor apartment in bad shape in a bad neighbourhood for that.
