You can restore your status but only as a visitor.
Hi,
I am sorry to sound like a broken record. But I think you might be wrong. IMHO, the person can only restore their status as a worker. Here is why I think this is the case :
1. Please consider the updated policy, procedure and guidance from IRCC regarding restoration of status :
It clearly says this :
It is important to note that an applicant can only restore to an authorization that they held immediately prior to the restoration application. As an example, a student who lost their status cannot apply to restore status with authorization as a worker.
2. Please consider this recent decision of Federal court in this matter (Ntamag v. Canada (Immigration, Refugees and Citizenship))
Ms. Ntamag could not simply rely on section 182 to obtain a different Temporary Residence status than the one she had held before she applied.
As of 8th April 2020, IMHO it seems, IRCC has become more strict -- owing to the above two decisions. It will only allow you to restore your authorization to the one that you held immediately prior to its expiry. It sucks but it is the case. Technically, in the opinion of court, "Restoration" can restore the status and not change it.
Please correct me if my understanding is wrong. This is important to me because of my situation.
