I got PR in October 2018, I came back to my country of citizenship after soft landing, then I went back to Canada in September 2019 and had to come back to my home country in June 2020 as my father passed away. Then COVID happened and I got married in December 2020. Got pregnant immediately, delivered a baby in November 2021, I couldn’t file case of my husband as I being a PR I couldn’t file his case from outside Canada. I am afraid I won’t be able to fulfil the residency requirement of 730 days in Canada, I just wanted to know if I file his case from outside Canada is there any possibility it would be processed??? Should I apply on the basis of humanitarian and compassionate grounds?
Don’t you think the immigration process is inherently biased against women?? How was I supposed to file for sponsorship from outside Canada when I was pregnant?? and I couldn’t leave my baby in my home country and go to Canada for filing their case. If it were any men it would have been comparatively easier for him but being a woman it’s difficult for us. I am really worried, don’t want to lose this opportunity as I worked really hard to get where I am today.

If anybody has seen any such case can you please give me some hope??
There is zero chance that a sponsorship application will be approved for your husband if you are outside of Canada. There's no point trying.

Your baby was born over a year ago. What has happened since then? Have you applied for a TRV or TRP for your child? Has your husband tried applying for a TRV?

I want to file for sponsoring my spouse and son under H&C
There's zero chance of approval if you are outside of Canada.

Have you tried applying for a TRV for your husband and child?

Your baby was born over a year ago. What has happened since then? Have you applied for a TRV or TRP for your child? Has your husband tried applying for a TRV?
I had a C Section then had PPD, didn’t try for TRV or TRP for husband or son. Was thinking of going to Canada for filing their cases but than realised couldn’t do so.

I would apply for the TRV asap, starting with your child. If the TRV is approved, you can travel to Canada with your child (same goes for your husband if he can get a TRV approved). Processing times are generally long right now. Get the application in asap.

See there is no other option, can’t leave my son here even for a single day, can’t go there without my husband or without his work permit. I am going to lose my PR Status anyway.

Might be time to determine if your quality of life would be better if you stayed where you are now...with your family.

i was good seven months pregnant with Gestational Diabetes, there was no way possible for me to travel there alone, and give birth.
How does gestational diabetes prevent flying? You can bring insulin and glucose monitor with you. You could have come back to Canada before getting married or before getting pregnant or after having your baby will be the argument. The fact that you needed to meet your RO needed to be factored into your plan when it came to marriage and pregnancy. Knowing you would need to return to Canada to meet your RO and if you were a PR would need to be in Canada and be compliant with your RO to sponsor your spouse should have factored into your personal decisions.

Your husband will not qualify for a WP right away even if he gets a TRV which will be quite difficult. If he gets the TRV and so does your baby you can both come to Canada but the only option is for him to either try to qualify for a closed work permit or for you to attempt to sponsor him while not meeting your RO which could lead to you losing your RO. You would likely have to work for months while he cares for the baby until gets a WP.

See it’s not just the flying part, I had GDM and my pregnancy was high risk with high chance of C-section. Since I have lived in Canada alone for 7 months I know it’s not easy living there especially when you had C-section and it was your first experience.

Although I know it isn’t the best option I have a family member who was a single mom, had a 10+ lb baby so has a c-section, was basically on her own as soon as she left the hospital with the baby, etc. Definitely not ideAl but also not uncommon. When planning to get married and have a child right away there seems to have been no plan to how you would still meet your RO.

Most women return to work after maternity leave and more and more women are the primarily breadwinner and so men are the ones remaining at home while the husband as the primary caregiver either for part of mat leave or for many years if having one parent at home is financially feasible. In Canada, both parents usually have to work due to the cost of living.

Not every pregnancy is planned and not everybody is courageous enough to make a decision to not continue with it. That family member of yours is a super woman indeed.
