Hi guys
I was wondering if under the new law (4/6), and since it is a one step process, the RQ can still be issued? And can it be submitted to a judge or processed by the CIC officer?
Any idea?

thanks

Obviously there are no formal or definitive indications about what residency cases will look like for applications made under the revised version of section 5(1), after it comes into force, but since section 14 as revised by Bill C-24, which is already in force, specifically still refers to the referral of residency cases to CJs, it is apparent that CJs will still play some role.

It is the approval and grant of citizenship which is now (as of August 1, 2014) and will continue to be (barring adoption of new laws not yet proposed) which is the so-called one-step process.

In contrast it is not clear what the actual practical procedures will be for cases in which CIC is not satisfied the applicant met the residency requirement, but it is a safe bet that some version of RQ will be utilized . . . a far more probing version is quite likely, since under the revised section 5(1) tax returns and intent loom as qualifying elements, opening the doors very, very wide in terms of what will be material information and documentation relevant to CIC's assessment of residency.
