Hey guys,

I am in a predicament. I received my AOR 17th May 2017 FSW-O, applying as single/never married.

I have lived with my girlfriend for only 8months (counting today) so I am not considered common-law. but on my application I recieved a request for further documents for them to continue reviewing my application.

This request was for the IMM 5409 which really confused me.

We have not lived together for 12 months so can't be common law. We do have a join bank account but surely this isnt enough?

The message says:
"Please upload these documents to your MyCIC account by 2017/07/04.
Please note: The above information/documents must be received within 7 days from the date of this correspondence. If this deadline is not met, your application will be assessed based on the information that was provided with your application and your application could be refused."

Should I try and fill in the form? my issue is this would be lying to CIC as by their definition we are not common-law. So i have no idea why they requested this!!!!

Any help would be amazing! Thanks in advance!

Is she coming with you to Canada?on the form you can clearly show the date when you moved together. So you won't lie for IRCC.

If you are not a common law yet, then under which status did you include her into application? Just provide declaration as it is, and add all evidence you have, like joint accounts, joint rent, mail to same address ets. Better not lie about anything, might backfire. Good luck!

Thanks guys, I didn't include her in the application at all this is why it is confusing to me. I am filling out the form and adding a note at the top stating that we are not common law and that in my EE profile i clearly said i was single / never married.

She is a Canadian Citizen, so i will be joining her in Canada essentially.

Within my letter I have included that I am aware of the misrepresentation and planned to inform CIC if my status updated at per common law definition on their website.

Ohh, I see now. Then no worries, if she is not on your application at all. Just send declaration and LOE. And good luck again!
