I landed in Canada on 25th May 2009 and I stayed for 1104 days in India in different phases since I landed in Canada My PR Card is expiring on 21 June 2014.I am in canada since 25th December 2012 My 730 Days in total will be complete on 4th June 2014. I have a house in my own name with my wife in Calgary since April 2013,and I am paying my mortgage regularly When I should apply for renewal of my PR Card. Will there be any problem in getting my renewal. I will be very much thankful to you for your guidance and valuable piece of advise.

If you complete 730 days on 4th June, apply at least after two weeks, the more you add number of days the better, I would advise 800+, unless it is urgent and in that case of urgency - at least 730+(2 weeks). Your paying mortgage only strengthens your case, but does not add any advantage to you on how early you can apply for the renewal. The 800+ days ideal case and 2 weeks minimum after 730 days, still holds - whether you owned a house and paying mortgage or not.

Keep in mind that they only look at a 5 year period so if you apply on June 4th, you can not count days you spent in Canada right after your landing any more because that period has moved outside the 5 year window. Apply on June 4th 2014, they will count starting June 5th 2009 so full 5 years.

Make sure when you apply that you have no more than 1094 days outside Canada in the past 5 years. That is the criteria as listed on the PR renewal form. If you have 1095 days or more outside in the past 5, you will be asked to explain on the form if you were posted outside Canada by a Canadian employer or if you were accompanying your Canadian spouse. If you have no such excuse, you would want to avoid having to fill that out. Having a house is not relevant.

Dear Leon

Thank you very much for your advise.I am still confused I am giving you the date of my entry and exit in Canada please help me and guide when I should appply for my renewal and what are the consequences if I apply late for the renewal after expiry of my PR Card.

Landed in Canada on 25th May 2009 and left on 8 Sept 2009 (Rest of the days stayed in India )

Entered Canada on 3rd May 2010 and left on 7th August 2010 (Rest of the days stayed in India )

Entered Canada on 25th Decemeber 2012 and residing till ...

Expiriy date written on my PR Card is 21 June 2014

Landing date is 25 th May 2009.

Please guide me when I should apply for my PR Card Renewal

Because you have more than 1094 days outside Canada since you landed, you will have to wait until the 5 year rule starts erasing days from your first absence to get you under the 1095 day mark.

According to my calculation, you were outside Canada for 1106 days. You need to get the number of days down to 1094 at least so you need another 12 days. Therefore, if your absence started on September 8th 2009, you will be able to apply to renew your card on September 20th. However, because it is not good to apply with the exact number of days, I would suggest that you wait at least until October 1st.

Nothing bad will happen to you if you let your PR card expire for a few months. There is no law that says you must renew right away. It is a lot better to wait than to apply to early because if you apply early, you will have a problem because you don't have enough days.

Thank you very much for your reply I will certainly apply for renewal on 1 Oct,2014.
Dear Leon I may have to go to attend some function of my Daughter in her in laws at the end of December 2014 for a short visit. In case we apply in Oct.2014 for renewal i) how many days it takes to process the renewal ii) As I may have to go to India to attend the ceremonies of my daughter in her in laws is there any way to get it on Urgently and what are the procedures and how much is the fee and how many days it may take.

The current renewal time is something like 3 months. You can apply for an urgent renewal if you have proof of travel like having bought the tickets already.

If your PR card hasn't arrived yet and you wish to go anyway, you can, but in order to return, you would have to apply for a PR travel document. I don't know how long that takes in India but you could possibly be stuck there for several weeks waiting for it.
