Relationship started during previous Sponsorship ~ HELP!!!

Hello - if anyone could help tackle the situation we are in, it would be appreciated!

My husband was previously sponsored by his 1st wife in 2001. This was denied, they re-applied and that was denied. An appeal was made and that was denied. Then most recently a PRRA was completed and that was just denied last week.

My husband was married to his first wife from 2001-2009, but the relationship was broken down and they were not living together for most it. This is probably why the relationship was found not to be genuine and the applications were denied.

We have been together since 2005, living together since 2007 and married in 2010. He is heading back to his home country at the end of the month due to the denied PRRA and we are preparing an outland sponsorship.

On his previous applications, it showed that he was living with his 1st wife, when we were actually living together.

How do we go about proving our relationship without contradicating previous information given to CIC? Because the previous application was denied based on the relationship not being genuine, does it even matter, or could there be a case for misrepresentation?

Is stating that our relationship technically started as an affair a bad route to go?

Any help would be appreciated!

Your case sounds very complicated I would suggest hiring a lawyer as it will definitely raise red flags for CIC. From reading appeal cases on CanLII officers do look back on previous applications and have denied for misrepresentation if the information provided is different.

CIC will definitely reference the previous sponsorship attempts, and with all due respect, CIC will not look favourably upon this case as it will appear to be a marriage of convenience. Imagine you were a VO...how would this case look to you? There is also some misrepresentation, as he was being sponsored by someone else while in a spousal relationship with you. I agree with the previous suggestion of seeking legal counsel, as you're likely looking at another rejection if you go through the normal channels.

wow its hard this case..try to get info from inmigration lawyer.where do you live?why you dont start new life with him in other place???

I agree with everyone else. This doesn't sound like a do-it-yourself case. Get a good lawyer.

Before retaining a lawyer, get a free consultation. If the lawyer says you don't have a hope, don't bother wasting your time and money to pursue this any further. Your case is extremely complicated, to say the least!
