I have now completed the assessment of your application for a permanent resident visa as a member of the Canadian Experience Class and have determined that you do not meet the requirements for immigration to Canada.

According to the Immigration and Refugee Protection Regulations, applicants in the Canadian Experience Class are assessed on the basis of the pass/fail requirements set out in subsection R87.1(2). The assessment of these criteria determines whether a worker with Canadian experience will be able to become economically established in Canada. The criteria are:

· knowledge of English or French,

· Canadian skilled work experience,

· Canadian educational credentials (for the Post-Graduation Stream only).

Your application was assessed based on the occupation(s) which you identified as part of your skilled work experience in Canada: technical support, NOC 2282 (level B); software developer, NOC 2173 (level A); IT developer, NOC 2174 (level A).

I am not satisfied that you meet the skilled work experience requirement. The letters of reference you have provided from Mount Knowledge, Bell and Rogers Communication did not indicate that you have performed the duties and responsibilities of NOC 2282 or NOC 2173. Consequently, you have failed to demonstrate that you have acquired twelve months of full-time skilled work experience in Canada at a National Occupational Classification skill of type 0 or level A or B in the last twenty-four months prior to the submission of your application and after having obtained your Canadian educational credential.

Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the Regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(1) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.

Following an examination of your application, I am not satisfied that you meet the requirements of the Act and Regulations for the reasons explained above. I am therefore refusing your application.

Thank you for the interest you have shown in Canada.

Hey so you reapplied in June 2012 and still waiting for medical? I see that the new formatted AOR doesn't have the 120 day sentence anymore. That means it might take a lot longer to get medicals now?

Hi Sabidhavan,

Would you list your details in the file? https://docs.google.com/spreadsheet/ccc?key=0Aui2RQO5umnddFA5cFR4Z3J4Y2d5ODZlUDZpaE9RV3c#gid=0
I am looking to get at least 10 applications who got rejected due to missing duties, then schedule a meeting with local MP and see how it goes from there. I live in GTA so if the applicants are from GTA as well it is even better. We may also schedule meeting with different MP's from the region.
Once there are 10 applicants, I will reach out in personal messages for further updates regarding the MP meeting and will also need further details (i.e. rejected application #, names, etc).
To stress again, it is important that the ONLY reason for refusal would be the missing duties while all other supporting documents proved the needed work experience/skilled profession. Thanks again to all participants.
