rejected - not convinced of experience

Hi all,
Our application for FSW was straight away rejected because the immigration officer was not convinced that my partner (the principal applicant) meets the requirement for NOC 0213.

Now, we provided the standard experience letter from company but it was difficult to get a letter with details of his job responsibilities. My partner has been a program manager for 4 years in a highly reputed MNC. We had mentioned in our application that we are providing the standard experience letter and if more details are required we are ready to provide at later stage. But Oct 12, we got a rejection letter stating that IO is not convinced of the experience under NOC 0213.

We sent an immediate online mail with more details to Delhi office. But received no response. Sent another mail on Dec15, still no response. Now, today we got the cheque for processing fees.

My partner "does" meet the criteria under NOC 0213 - been a program manager for 4 years. Is there a way to appeal to re-evaluate or reconsider the decision?

Thats unfortunate. Did you detail the job responsibilities outside the form? You could prepare a page with the time period, nature of work, full time employment details etc and then substantiate it later with a reference letter as well
How many years of total experience do you have?

gdnm, sorry to hear that. I'm afraid once the file is rejected and the check returned, there is nothing you can do to re-evaluate or reconsider the decision (learned it the hard way). However, you can re-apply immediately - but this time make sure you prove his experience. From your mail itself it is clear that you did not provide enough evidence - remember, for this fast track process, you get only one shot at substantiating everything you said in your initial application. They will not accept/ask for anything 'at a later stage.' Get any and all evidence for the job responsibilities. A superior's letter, contract/job offer, pay stubs with the post mentioned, non-confidential communication with clients in the capacity of a manager, anything and everything you can think of. FSW means they need to be thoroughly convinced that you are really an FSW, and especially for 0213 they have been really strict at ND. If you haven't included IELTS, include that too next time. Homework, More Homework needed before sending to CIO.
Had your posts been more than 2: as I can see now, We are here lots of experts and experts-wannabes could help you with your problems. CIC is now strict on Jobs and duties description. They are returning applications even for minor wrong doings. They cant accept people those do not follow their rules and advices listed on their sites.

Should you set you mind to reapply, I'd tell you to immediately contact an experienced Immi Consultant. besides, we are here always ready to help. Did you publish your J/D in this forum before sending to CIO. I still get a feeling that you still have a hope.

Your case looks good to me as your partner is a program manager for about 4 years. Please gather all relevant proof from the company regarding job duties and make sure that it matches the duties described under NOC code 0213.

My partner has 9+ yrs of total experience, and I have 8 yrs of experience in similar field except I am not a manager.

Along with our application we had submitted
- appointment letters for all jobs
- promotion letters
- payslips
- short description of duties performed (maybe this should have been long)
- standard experience letter from the company with HRs visiting card (HRs really don't give detailed letters)

We didn't provide detailed letters from our immediate bosses for confidentiality reasons and we had mentioned that in our application too, and if required we can provide more details at a later point when they need it.

But the IO straight away rejected the application. We work in highly reputed MNCs, if they wanted to check, they can google the internet, find us on social networking sites. I think none of this was done.

We immediately send a follow up message through the online system. got no response.
Followed up after 2 months in Dec, again thro' online, no response at all. though it says u will receive response in 48 days.

We really didn't think it could be so difficult. I have been to Canada on tourist visa twice. My sibling is a Canadian citizen. And I had a good experience in Canada. They are very courteous and people friendly. We had more than sufficient points (81) and really didn't expect a rejection - worst expected them to come back for more details.

As a last resort we have sent postal mail - hardcopy - with our "appeal" letter and our detailed resumes. Only other detail document could be appraisal summary to prove the duties done.

Other thing, they only returned the processing fees paid to ND CHC. So, initial approx Rs. 50,000/- fees paid to Nova Scotia office is all gone wasted. Atleast for the sake of hefty fees they charge they should spend sufficient time on an application.

I don't mean to sound harsh since I understand your frustration but at CIO stage, they won't ask you for anything else later, they get thousands of applications every month, imagine if they go google or Linkedin every company in every application they receive, so it becomes your responsibility to provide every document requested. I would be more empathic had you turned in all documents and they had overlooked it but this was not the case. When I applied, I wrote the job description myself, however, my application was to Quebec so I don't know if CIO accepts it like that, but I did confirm with BIQ (quebec immigration) if I could do this. Please do not missunderstand what I'm saying but understand that neither CIC nor BIQ will bother too long to look at your application and will tend to err on the side of rejection/returning. For the record, I had my application returned twice cause they didn't even bother to read my application was for Quebec so they treated it as a Federal yet I provided everything needed for a Quebec application.

gdnm, you will get your NS application fees refunded too if the application was refused on lack of evidence. It takes a while because I believe it's the NS which takes care of the refund for applications received there. Again, I'm telling you the 'hardcopy appeal' won't help you here. Been there, done that. They are courteous enough ;) to return the whole package saying once a rejection is decided, that is it. There's nothing you can do to reopen the file.

Anybody who is anything in IT are all applying under 0213, and hence the stringent reviews and rejections. Now, if you are really interested to pursue this dream, don't waste time, re-do your application and include anything and everything that you can think of to prove your partner's experience. From your subsequent post, you seem to have a lot of positives favoring your application. Prepare a strong cover letter including all these points bulleted. Don't lose heart. I'm sure you'll make it this time. Good luck!

Something that sells yourself, just like a cover letter for a job - emphasize the skills/characteristics that they are looking for that you have. It would be different for each person.

Who has that much time to fabricate their subordinates?
I requested my senior Manager to issue me a J & D letter, he said he didnt have much time, he referred me to his deputy, I am gonna get my J & D from him. He too told me to prepare one by myself and then he will check , if its ok, he will sign or he will give corrections.
