Hi All,

I relinquished the PR status on 2011 but kept visiting Canada constantly with multiple-entry visa for the past years to visit my wife and kids in Canada who obtained their Canadian citizenship in 2016. I would like to have the experts guidance on the following:

1. how can i reinstate my PR status as quickly as possible when i arrive to Canada (i need to apply inside Canada while living with my family, unless there is an urgent way to reinstate the status in month or so outside Canada.

2. I thought of applying via Family Sponsorship inside Canada but looking at the estimated processing time of 12 months shocked me and scrambled my plans. Anyway, if that is the only way to do it, is there any preference on which city/province offers the quickest processing of such applications (i am based in Nova Scotia but planning to move to Ottawa or Toronto)?

3. Since i had an RP before and i have an active SIN and i paid taxes all these years as i was determined by CRA as factual resident because my family were living in Canada. Does this accelerates or complicates the reinstatement of my status?

4. Let us assume that i can get the OWP in 2-4 months from application date, would this OWP allow me to apply to post-graduate degrees (i am pursuing continued higher education degree) in universities as an RP?

5. Any other guidance on documentation required from the country i am coming from to help my application get accelerated in Canada, like police certificate, experience and reference letters to help in finding a job, medical fitness reports, ..etc?

6. Finally, i heard that the liberal party promised to expedite family sponsorship applications processing time, but i what i see is that it got worse or what?

1. There is no rushing it, you can expect it to take 12 months as you saw.

2. This is your best/only option, and the processing time will not be impacted by the city in which you live.

3. It would not accelerate the process at all. I guess whether or not it would complicate it depends on the circumstances surrounding why you surrendered your PR status.

4. No, the OWP allows you to work only, not to study. You can also expect it to take 4 months, that processing time is very consistent.

5. Not sure here

6. No it has not gotten worse... inland applications previously took an average of 26 months. They take 12 months now.

Thanks @KBH for the quick response.
Two comments:

1. Outland was claimed to be faster in processing, yet, it takes as much as inland applications as per CIC processing time data (i tried many countries for the sake of benchmarking .. all same)?

2. inland applications excel sheet proves that 12 months for 80% of applications promise is not accurate. Majority have more than 12 months since receipt of complete application. any idea if the claim of 12 months is accurate?

They are processing 80% of inland applications in 12 months or less.

Outland also has a 12 month processing standard, but many are processed faster than that. It is unpredictable as it depends on your VO and particular application. That's why they stick to a 12 month standard as to not overpromise to anyone.

I don't really understand what you mean by reinstate your PR. Did you renounce your PR status back then?

If so, you ARE no longer a PR. There is nothing you can do to "reinstate" it.
You can ask your spouse to sponsor for your application of PR through the family class.
If you want to travel in and out of Canada during the application, you should apply "outland".
You will not be able to apply for OWP with an outland application. (4 months)
Both outland and inland application is target for 12 months process time.

Inland used to be much slower but it's now depend on the VO.

No you cannot. Once you apply for either, that's what you're stuck with. You can apply for outland then come to Canada to wait for your app to finish processing but if an interview is required, you'll have to travel to the VO processing your app to do the interview. If you apply inland, you cannot leave Canada for extended periods of time or IRCC might cancel your app.

There is no magic available. You are starting all over from the very beginning. New PCC, new medical, new background check - everything. Option 2: Applying OUTSIDE Canada = the application is called "Family Class".

i have another question, If i am applying from INSIDE Canada but i need to tell them that i will be outside Canada (for 2 benefits : 1. to accelerate the application processing. 2. to allow me to travel without restriction). What application type should i submit ?

Correct. You can be inside Canada and still submit a "Family Class" application. You can't do it the other way around. In your case, it is appropriate to use Option 2.

You would select the option on the checklist of Family Class residing inside Canada. You would not lie and say you are outside Canada. You are allowed to apply outland while being in Canada.

1. Can i still apply for OWP when i submit a family class application (outside canada but residing in Canada)?
2. Should I inform the immigration officer at the airport that i am going to apply for family sponsorship when i arrive to Canada (i already have a visit visa)?
