Hi, i just want to know the chances of getting approved as spouse after the refusal of conjugal partner. we got married after a year. Will the refusal affect the new application if ever? thank you!

Depends why you were refused. If the conjugal application was refused because CIC said your relationship didn't meet the requirements for a conjugal application - then you should have no issues submitting a spousal sponsorship application now that you are married. Make sure you declare the refusal in this application where asked.

thanks! we are in same sex relationship and i was a permanent resident before. they said in the letter that we could have stayed together for a year become common law back home. it says on the gcms notes that we have established relationship.

Your response isn't all that clear. Are you saying that you were refused because CIC said you lived together for a year before the sponsor came to Canada and became a PR? Or are you saying something else?

i think he means CIC found no legal barriers that would have stopped them from becoming common law

As long as you never lived together for 12 months before you got your own PR status, then I also agree your previous rejected conjugal app should have no negative impact on your current app. In fact if the previous conjugal app actually found you had established relationship clearly and only reason for rejection was no barriers to common-law/marriage, that could actually benefit your current app since the visa officer will see the previous officer accepted your relationship as valid already.
