Refused visa application

We submitted an application and was acknowledged by IRCC last Nov.19. two weeks later, December 3 to be exact, I received an email from my consultant forwarding IRCCs refusal letter. And as stated:

You have not complied with our request for information, per subsection 16(1) of the
IRPA. To date, you have failed to comply with our request for submission of the following
documents: NBI clearance. The one on file belong to another person.
• This information is required for application assessment and was requested as per the
document checklist: https://www.canada.ca/en/immigration-refugees-citizenship/services/
application/application-forms-guides/imm5483.html


Could someone enlighten me what will happen with my application. My consultant tells me that there seems to be an error on IRCCs part as we have not been asked and we have not submitted any NBI clearance. He also told me that he already filed a webform for reconsideration. Does anyone know how long will it take and what are the chances of the appeal?

Also the second reason for reason for refusal is getting me confused. I am applying for a work permit but when I open the link it says document checklist for Student permit.

Somebody help me pleaseeeee.

I don't think there is any error on IRCC's part. Almost certainly your consultant screwed up. Looks like your consultant uploaded the wrong document and mixed up your file with another client's.

Reconsideration takes anywhere from a few days to a few months to hear back. No one here is going to be able to tell you the chances of approval. This is not an appeal process.

Reconsideration takes anywhere from a few days to a few months to hear back. No one here is going to be able to tell you the chances of approval. This is not an appeal process.
Thats also what I think coz how come someones file will end up on mine. Consultant is kinda douchey. I just dont have a choice coz he is the companys immigration lawyer.
Do you think it will be better to submit a new application? Or just wait for a response on the reconsideration? I dont wanna waste time on something that I am not sure of the outcome.

Any updates on your application?

My sister spousal open work permit application has been refused today for the same reason - no NBI clearance submitted. =( It was not listed as a requirement on her online application but it seems to be necessary. She was denied exactly two weeks after submitting her application

App Submitted - Dec9/24
Biometrics Requested - Dec9/24
Biometrics Completed - Dec12/24
Medical Requested - Dec15/24
Medical Completed - Dec19/24
Application Refused - Dec23/24

I just realized that Philippines has a documents checklist - Work Permit Manila Visa Office Instructions

This link also mentions that Police Certificates is needed in addition to the medical exam.

Do you have any updates here? How long did you have to wait for the reconsideration decision? I just experienced the same thing on my OPW application.

What were reasons for refusal? Reconsideration is for an error in law.
Says that I have not submitted the “requested” NBI Certificate. Which my consultant said that they have not received any request from the IRCC to submit such. I am thinking that re-applying is for the best. Any thoughts?

Reapply with all the correct documents. You are responsible for submitting a complete application. Is spouse in Canada as student or worker?

I actually sent my NBI to the consultant. They just didn’t submit it to the IRCC because they haven’t had request to do so. But anyway, my husband is a worker in Canada and on the process of his Permanent Residency. Really considering to re-apply now. Thank you!

If you reapply, do it on your own.

What the consultant did may have been half the problem.

Hello @kimmy423, I just resubmitted my sister's application with the NBI certificate, and it was approved in less than two weeks. We were also frustrated when her application was initially refused due to the missing NBI certificate. However, after further research, we found that submitting the NBI certificate is mandatory according to the Manila Visa Office checklist/guidelines.

Just try resubmitting the application with a valid NBI certificate, and hopefully, it will be approved soon too. Best of luck! =)

Yeah but we’re gonna have to wait until next year i guess for him to be PR because he didn’t have it on Express Entry. Our plan is the easier way which is to wait for the process in Canada. He’s a fishplant worker and permit expires Oct 2026.
