Refusal of Work Permit at the last step

Hi There,

I hope someone can give me some insight on if there is anything that I can do for the following situation.

In late 2011, my business applied for an LMO for a warehouse manager. We have had a manager work in our store for 3 years under a work permit and he left to return to India (his home country). The LMO was approved in November 2011 for 2 years.

He applied in India for the work permit after completing all the necessary paperwork. We just found out he got a rejection letter yesterday due to 2 reasons.

The first reason was that he had previously worked outside of India. I don't see how this should have been a factor in the decision as one of the main reasons he was selected was for this reason alone. His communication skills were quite good due to him working in different countries. He always returned to India and never overstayed the dates his paperwork showed.

The second reason was that he did not show enough assets to ensure that he would return to India. Everything that he was able to show was in his parents and grandparents name.

I had gotten an approval for a 2 year LMO and have been holding this job since November 2011. Is there anything I can do to rectifiy this situation?

hi buddy, sorry to hear the refusal first of all.

well, one needs to show very strong ties to the native country in order to get work permit approved.

the only which cud be done in present scenario is to write a re-consideration letter to the VO stating the
entire situation along with submitting an affidavit from the employer that the employee will be returned to
the country(india) after expiry of his work permit.

going for judicial review will not be wise in this situation since there is nothing for the judges to decide, because
its more or less VO's discretion to grant visa or not.

I can suggest more, if u can publish or forward me the refusal letter.
we may get something technical(legal) out of the letter which may become the ground for judicial review(if option one fails).

Basically the letter states

" You have not satisfied me that you would leave Canada by the end of the period authorized for your stay. In reaching this decision, I considered several factors, including:

- limited employment prospects in your country of residence
- your personal assets and financial status"

There is nothing else in the letter that is specific to the case.

I am drafting a letter and if you have any other advice, it would be greatly appreciated.
