ohh ok so i can just send the ATC and the sponsorship in together, i didnt know i could do that i thought it was seperate, thats good to know though, I have literally everything on that checklist so hopefully nothing is missing. I also realized that my hubby got them to pay for his ticket which is going to run me 1600$ when am i supposed to pay that? (bad legal advice) we realize we should have paid for it ourselves
omg that sucks you had them pay it for you, well no biggy you will just have to pay it back, but dont worry about it now you will have to wait for when they ask you for it, when the process is almost done. how many months does your visa office take to process and application? btw its called ARC not ATC lol. the reason i said you can send the ARC now is becasue he need his RCMP and since he is not in canada anymore you can send it, cause it expires in 6 months time.

The 18 months is how long it took CIC to process 80% of applications. This means that 20% of applications took longer than 18 months to process.

I don't know what this ATR is that you guys are talking about. I think you might mean ARC (authorization to return to Canada). You will need this but it will only be requested by the Visa Officer as your papers go along.

I'm in the same situation, I'm currently at the end. My husband has now been back home for 17 months. He too failed refugee, failed PRAA and was removed.

You don't need a lawyer, all you need is to be prepared if they ask you for an interview. You can fill out the paper yourself. Use this website as guidance. The longest process is the RCMP. Because your husband has been in Canada longer than 6 months, they'll request fingerprints to be forwarded to Canada. This is a big chunk of the timeline with him getting home. My husbands RCMP took 7 months to complete. Currently were waiting on the ARC to be approved, were at month 3. It'll be a very long time so be prepared.

nope you can't put in the ARC until the Visa officer asks for it. If you go ahead and submit it ahead of time, it's like you telling the VO that they've given you the approval already when in fact it's their decision. You can't send the ARC until they request it. Just submit your application and they will send your husbands letters when they want the prints done and once the prints completed and it's received, then a month or two later they will send the request for the ARC. But that is only if they are on the verge of approving him to come back to Canada.

Honestly you will be fine. It's just a long process. And in all honesty you don't need to waste on a lawyer. I applied for my husband and he's in Kingston Jamaica. But it's been 3 months going on 4 very soon that we've been waiitng for the arc to be approved.

Husband went back to Jamaica - September 27 2011
Filed Spousal Sponsorship - October 31 2011
Approved as Sponsor - December 28, 2011
Documents Received in Jamaica - January 10, 2012
Application in Process (ECAS UPDATED) - April 2, 2012
RCMP Prints Requested - April 15, 2012
Fingerprints Completed Prints Brought into Embassy - April 22, 2012
RCMP Prints in System in Canada - October 5, 2012 (it took them 5 months to actually put it in the system even though they had it from May)
RCMP Prints Completed in Canada, Mailed to Kingston - October 26, 2012
ARC Request - December 10, 2012
ARC Documents and payment brought in to Kingston Embassy- December 11, 2012
PPR Request and additional document request (rec'd through email) - February 5, 2013
Dropped off Passport and Documents along with DHL Waybill - February 6, 2013

actally @tintin let me correct you on that, lawyers and councellor always recommend to send stuff even if they didnt u ask for, the thing is the VO is not the one who wants to come to canada, you are the , tne, if you know what you need to submit you have to send it,the immigration officer doesnt really know what you need unless he goes through your application and he realise that you need it, but you have to be proactive, if you go on CIC website they will tell you what has to be done to immigrate, so its your repsonsiblity to give them the information, dont wait until the VO realise u need it to send it to him, then he is just gonna put yur file on a side and ask you for it and when u eventualy get it to him, he is not even sure he is quickly going to work on your file thus time keeps wasting, so what am saying you know what u want you know what you need to immigrate its outlne for you on CIC website, give them everything THEY NEED not everything THEY ASK FOR it will make theirs and you job easier.

for example you want to immigrate to canada lets say you was deported , you was married before you have children, you have crminal record all those things are red flags, so what you gonna do just send them a simple application and not try to send thing to fix those red flags, so after 12 months of waiting for the basic time to go by you now going to wait another 6 months for them to get when u send the ARC or whatever they eventually will ask for. am just saying find out what they NEED and give it to them dont wait dont wait and dont wait, that all am sayin, dont wait for them to ask you it delays time and lengthens your process as well.

You're right. But my case was complicated, just as complicated as the poster. my husband was married even before and he didn't attend the original interview for his immigration hearing. then he applied refugee, then praa then married me. The process has been pretty straight forward for us. He went back to Jamaica. We sent through the sponsorship forms and nothing was returned. 6 months after we submitted the application, it was in process, couple weeks later they requested for him to send in the prints and then 9 months later the VO sent the letter for the ARC and we sent in the payment and a letter explaining why he should get to come back to Canada. So now were just waiting on the arc to be approved.
I've never filled out these forms before , it was my first time and we filled it out fine without any problems. I had his baby one month before he was removed from Canada, submitted all i had to submit and now were at month 16. Lawyers are just sometimes overated , even consultants. Reading this site and cic site helped me with filling out my documents and educating myself on the whole process. But your right, nothing wrong with her getting some guidance from other sources.

but every country is different. With Jamaica you have to wait until they request the prints and the ARC, you cannot be proactive and send everything in.

i get you @tintin but mine is as well complicated, i was married before and my application was withdrawn with my previouse wife who was a very wicked person, and then i applied refugee go engaged my refugee was denied and i got married then i was deported 6 months after marriage and after my application was sent. so mine wasnt straight forward, i have an interview sooon but in jauary i sent another package to POS, in it i added some more information like pictures, insurance, etc and also i sent them the ARC with the money order, again i know its necessary so am not gonna wait for them to ask. the thing is there is no where that says you have to wait for them to ask for something before u send it, or maybe i could be wrong. :p :p :p :p :p

there's no forms for the ARC. it's just a letter you write outlining why you should be able to return. If you need help with that just PM me and I give you the outline of the letter I did for my husband.

the medical clearance would not be sent to you niether the RCMP to my knowledge since he is back home, all he has to do is gonna to the neccesary places and do the medical and RCMP and those places are the ones who are going to send it to POS themselves. so maybe when u send it to mississauga they might or might not tell you that your application is not complete and they will send you the form to then send it to him and he now has to go and do them and they will send it to POS all u need to give CIC is the receipt of confermation that he did it, and then they will send your file to POS.
@tintin actually there is a form and also a checklist for the ARC accompanied with a letter, you cannot find the form online because CIC dont want u to find it. i supp ose to have a copy on my pc someplace.

I didn't send it right away as they have the power to not provide you with your PR. Remember if they determine you're relationship is not genuine, they wont' need the ARC. So it's kinda like your jumping the gun and telling the Visa officer "you're gonna approve me anyways so let me just send in my ARC and prints and you'll move quicker" there is no guarantee that you will get PR, i'm not saying you won't but with immigration there is no guarantee. There's ppl that have all the proof in the world and they are denied. People married for years and they go through the process and when it's time to get the ARC the VO doesn't bother going further cause she's gonna decline your paper anyways. Some VOs are a$$holes so I was informed it's highly recommended to wait until it is requested. But who knows you might be fine with doing what you did.
