Hi
I applied for refuge in 2021 and was denied in January 2022, I have not yet received the removal order, but I have a common law process since February 2022, last week I received a letter asking me to do medical exams and send some documents to obtain my police record from my country of origin, my question is can I still be asked to leave the country?

What stage of the common law process am I in?

thanks for the help

This could be good news. Typically these are requested after the sponsor has been approved, meaning that the applicant would be at the AIP stage - Approval in Principle, which is the second part of the entire process.

Good Luck!

*When i call immigration offices they said my background review still in process , I send all my documents since Late August 2022

I'd check, you probably did submit the request for open work permit under the inland sponsorship process - it's just one form and you could have missed it if completing all wtih spouse.

Hi, today I received a letter telling me this
This refers to the Application for Permanent Residence you made under the Spouse or Common-Law Partner in Canada Class.
Please be advised that your application has been transferred to an Immigration, Refugees and Citizenship Canada office in Etobicoke for further assessment. The Immigration, Refugees and Citizenship Canada office may contact you for an interview or to seek additional information or clarification. That office will make a final decision on your APR and communicate to you its decision.
What this mean ?

Typically, that office gets applications that require some degree of additional scrutiny. This is NOT to say that it's automatically a bad thing.

If you applied for asylum in 2021 yet became common law in February 2022 you would have had to be already living with a PR or Canadian citizen when you applied for asylum or have moved in together almost immediately after claiming asylum. When did you enter Canada? What was your status then?

Hi,

Today I received a letter saying that I incurred misrepresentation, and I have 30 days to respond.

The specific error is the following:

Specifically, I have concerns that you misrepresented your admissibility on your Schedule A.

How did I respond to this? What do I have to check?

Did you declare the failed refugee claim in your application? Did you also declare how long you have been in Canada out of status? Overall, I would strongly recommend you hire a lawyer to assist you at this point.

Agree that you need a lawyer. The timeline and status of you time in Canada is unclear. Based on your previous posts you were living with your girlfriend in Canada for 6 months before applying for asylum. It’s unclear when you entered Canada and your status during that period of time.
