hello everyone.

my husband tried to sponsor me on a family sponsorship class but my application was denied because he didnt declare me at the time of landing when became a permanent residence. though my daughter was exempted because she was born after my husband became a PR.

a year after i was able to apply for a visa to usa. Now am in USa on a visitor visa.

my question is can i seek refugee at the boarder. will i be allowed to claim refugee with my daughter because i have been denied on the family class?.

and i hope it wount affect my husband status in canada.

am just confused.........

Extremely unlikely that a refugee claim would succeed unless you can demonstrate that you are in fact a genuine refugee. It's not just an alternative way of getting round IRPR 117(9)(d). It's my guess that your prior interaction with IRCC regarding the failed sponsorship attempt would weigh heavily against you.

She will not be immediately turned away, if that's what you mean.. Family in Canada is a valid exemption from the Canada-U.S. Safe Third Country Agreement.

Your husband is not classified as a family member since he failed to declare you in his application. So that likely won't work.

my concern is just if they will allow me make a refugee claim at the border.

Yes - the uncle will work provided he's living in Canada.

Why wouldn't you just have your husband sponsor your daughter? What would be the reasons you are claiming refugee status?

CIC may examine your refugee application more closely to ensure you meet the requirements to be accepted as a refugee and aren't an economic immigrant. Make sure you have the evidence requirement to support your refugee claim.

my concern right now is just if i will be allowed to make refugee claim at the border as regards my situation and that i wount be return back to usa
