Got Eligibility and referral on October 18, I got a letter by mail last week that my hearing has been scheduled for December, I am worried that the hearing might be postponed because of the 6 months gap between now and then, my lawyer told me this gap won't impact my hearing going through smoothly in anyway. Is it normal receiving your hearing date 6months in advance, cause most people I know got theirs like 3 or 4months before.
Usually it takes 3-4 weeks to receive the decision in your mail, but it sometimes takes 3-4 months. I read in the forum that some people waited 5 months until they received the NOD.
Maybe it is a good idea to contact IRB to follow up in this regard (by you or your representative if you have one).
It will not create any issue. Because of the huge backlog, there is considerable delay everywhere. The member who is processing your decision has so much besides your decision. This is why it may be helpful to make a call especially if the hearing was before 2 months or more.
I read somewhere here in the forum about how to contact IRB. Try to do some search. What I remember of what I read earlier is that when you contact IRB you have option to be referred to the member who is handling your decision. Then you can either talk to their office or leave a message with your contact so that they can call you back. This is the best thing to do.
