Good morning,

I’m seeking advice regarding withdrawing my refugee application and processing with my spousal sponsorship. I firstly applied for refugee status but I had unresolved court case that cause my claim to be suspended for 2 years , within that two year period , I got married and submitted an application for spousal sponsorship ; the application status is still under review , I did biometric last month and now awaiting on update .

I recently received my hearing date and time regarding my claim , which will be in April .

Would I face consequences such as deportation if I sent it in writing to RPD that I wish to withdraw my application?

Do not withdraw the refugee application. Yes, this will active the removal order.

But I wish to proceed with the spousal sponsorship instead of claim. There’s two applications running simultaneously. I remember the lawyer told I could withdraw one before decision is made .

so , I have to attend the hearing?

Yes, I know you want to go through spousal sponsorship. However if you withdraw the refugee application now, this will activate the removal order. You definitely don't want to do this. You need to keep the refugee application in play until the spousal sponsorship application is approved. Yes, you should go to the hearing.

I would really love some assistance , thank you .

Two separate systems. Did you have a hearing in April?

Your passport is with the IRCC or CBSA office that seized it, so you would need to request it from the relevant office according to their procedures. The office sending you your PR card likely does not have your passport.

Would add that if you were deemed a protected person before you got PR via spousal sponsorship you are still considered a protected person.

Good morning,
I showed up for my hearing but after waiting for awhile , I called and they told me it was rescheduled until January , so I’m yet to do a hearing which I think isn’t relev anymore , right?
So yes you are not a prefects person and you need to withdraw your claim asap
