Hello i have applied for asylum 7 years ago . upon unforeseen circumstances i had to go back for awhile because my of a property inheritance . now i guess i already jeopardized my status and will face cessation. is there a way i can appeal it after my return .
actually i have a clean criminal background . is h&c an option for me
in the worst senario because i filed out forms for my citizenship application and submitted it before my return

Did you come back to the Canada ? Did they start cessation? I know someone who was living here around 20 years. Person was going back home for vacation sometimes. Citizenship application was in process. But they did not approve and deport her.

If the government pursues cessation, you can certainly try to appeal. Expect the process to be very long and drawn out and take several years. You will need a very good lawyer.

Do not make any further trips to your home country.

This has nothing to do with having a clean criminal record. This is around returning to your country of persecution. Your clean criminal record does not factor into the decision.

If you end up losing your PR status, assume that applying for PR under H&C will not be possible. If you lose your PR status and are removed, the option you will have is to try to qualify and be selected for PR through an economic immigration program like Express Entry from outside of Canada.

I don’t know. That’s so stupid. But it’s their choice. Because you don’t have to be citizen. So you will see when you come back.

There is no issue returning after you have become a citizen. The issue is returning while you are a PR. You are still a PR, correct? If so, then good chance you will face cessation.

in my case i am pr claim based on asylum

I've already answered this question. Cessation comes up when you travel to your home country while a PR, not after citizenship. So you are at risk of cessation since you are a PR.

You should return to Canada as soon as possible. I don't know how long you have been in your home country, but the longer you remain there, the bigger a problem this will likely create for you.

You should assume your citizenship application will not be processed quickly but will most likely be put on hold for several years while the government determines if they will pursue cessation.

Do not travel again to your home country while you wait.

Hire a lawyer as soon as you are back in Canada and get a consultation with that lawyer on your situation.

I'd argue this can be an issue if you retain or renew citizenship or passport after becoming a Canadian citizen, particularly if you are detained in your home country.
