Ready to apply on April 1st, but unsure about paid vacation

Hi all

I'm going to send my CEC application on April 1st, exactly 1 year after I was hired for my current job. However, i have 3.5 weeks of paid vacation (3 weeks is the one year allowance and must be taken).

Will I still be considered as having 1 year skilled work experience?

I cannot wait longer because my police certificates were taken on January 4th and in the application guide it says that they have to be maximum 3 months old when submitted.

Well, I would not take any chances when its just a matter of a few weeks. If I were in your position, I would wait for 4-5 more weeks before applying.

If PCCs are expiring, I would recommend to obtain them again and send them later after receiving the AOR.

mmhh but then I would have to ask the embassy for them and I'm not sure how long will it take, I cannot go home for another year. If it's a 3 weeks paid vacation per year why should not they be counted? There is nothing about paid vacations on the application guide

Exactly, that's the point. Its open to interpretation. If, unfortunately, the VO interprets it in a way that he will not consider any vacations over 2 weeks (for whatever reason), your case might get refused after months of waiting.

PR is for life, and it would be very sad to see any application rejected for a reason that's avoidable.

Is there any case of someone being rejected on a paid vacation basis? It really boils down to wait a few weeks (and reprint all of the forms :-[) and go through the request for police certificates for which I have no idea about from Canada, or just risk it...

Mate, no one can stop you sending the forms you've got now but I would personally give myself more of a buffer to allow the VO the benefit of doubt. I'd send them closer to May/June, tbh.

lets remember there is two sub classes of CEC. there's students and workers. for students (ie those who graduated from a canadian institution) it's 1 year full time ( or the equivalent in hours - 37.5/week) this includes vacations. I applied using exactly 1 year of full time work post graduation and the vacation time i was entitled to - and took - did not affect my application.

for the workers, it 2 years and i would imagine vacation is included there too.
So it should be ok? I know now there is no difference between sudents and workers but still...

Well, 2 years for workers, seems to be very old info (atleast older than Jan 2013)

As suggested by Matt, no one can stop you from sending your application. However, since you asked, it's our sincere advise to wait for another few weeks.

Having said that, there is always the chance that VO might consider your vacations alright and grant you the PR (given everything else is good). But, there is a BUT.

ok thanks so how much should I wait? 2 weeks is good? That means I could apply on Monday April 14th... Should I still send my police certificates and in the meantime request new ones?

If its not a problem, then wait for 4 weeks, get the experience letter dated by end of April and submit the application. You could very well send your PCC with the application, if CIC wants, they will ask you to submit a new PCC at the time of MR for which you have a few months lead time. My suggestion is to wait for 2 - 3 months before requesting a new set of PCC.

That's April 27? Ok will try by then thanks. I will wait to get new PCC then but I will need to check how long it takes to get them...

You can always send the Police certificates later. But do not take any risk, apply with some extra time in hand.

Read about a fellow applicant, who applied on May 2013, got refusal letter after 10 months. He applied with 367 days of experience. Visa officer failed to see those extra 2 days and refused his PR. He is currently asking CIC for a review.

About vacation days, I think I can help:

An allowance for a reasonable period of vacation time will generally be made in calculating the period of qualifying work experience (e.g., a two-week period of paid vacation leave within a given 52-week period in which the applicant was engaged in qualifying work experience). An allowance for normal vacation time during a period of qualifying work experience cannot be used as a substitute or proxy for meeting the in-Canada element of the work experience requirement (i.e., work experience obtained outside Canada will not be considered as though the applicant had been on a period of vacation in order to be counted as part of the period of in-Canada work experience). While officers will account for a reasonable period of vacation time in calculating the period of qualifying work experience in Canada, each application is considered on its own merits with a final decision based on a review of all the information available to the officer at the time of decision.
