Guys,

I am a July 30 2014 FSW1 applicant . Want to share my sad story and seek your expert advice .
I had received my PER NOV 2014 and ECAS had line update "We started processing your application" by Jan 21 2015. Then on there was no update . And I was patiently waiting till this week.
I did apply for GCMS notes last month and haven't got yet.

Two days back my attorney received email that my application was refused because CIC HAD ASKED FOR MEDICALS/CLEARANCE AND RIGHT TO LANDING FEES ON FEB 19 2015 .
Since this was never submitted , CIC cancelled the application .

However the email from CIC, nor their reminder email was received . Funny part is the ECAS online status never updated and only this monday it showed "Medical instruction required " line.
Our Attorney had sent for reconsideration saying CIC email was never received.

Why would CIC rely on email communication , even if its worth why cant ECAS show correct update status. All these incidents triggered only after i applied for GCMS ???

Please can you guys advice me on the following
How long it takes to re-open the case? Is there any probability of getting it ?

So sorry to hear that have you and your attorney checked in inbox junk mail if its still there most likely it get cleaned up after while.

Its hard to prove if you can't access junk mail folder and inbox for email provided.

But If i were you at least try to appeal based on lost email case.

I am not expert in this issue I would have expert advice you in this case In this forum I have seen one case where email got lost and someone won that case against CIC and got 5K in compensation and re opened his file.

Hi...Its unfortunate to hear that. What was the email address specified in your application? Was it yours or your attorney's?
If it was attorney's then you can complain to CIC from your side as well , like re appeal etc if he is registered by CIC and has a registration number.
however, I would say, update your documents and apply for express entry in the meantime.
So your appeal as well as new application would be in process simultaneously....Hope and wish you succeed

Thank you guys your replies are consoling.
The email address specified was attorney's and he claims confidently that it was never received.
He had sent an email to CIC stating it was not received , he advised that I should hear back in 30 days .
Do you think I should wait for 30 days , look for result and then apply for express entry, or start now itself?

And I am following this posts for long, I see lot of ppl stating that they did not receive medicals or next calls. For those please follow up , dont loose like me
