Hey everyone, my wife and I have been checking out this forum for a few weeks and think it might be a good place to maybe get some clarification on a couple things regarding outland family class sponsorship.
I am Canadian, my wife is Mexican. We were married in Canada and our toddler was born in Canada. The three of us have been together in Mexico over a year now and getting pretty close to submitting our sponsorship application. My wife was given a deportation order due to taking bad advice from a nasty consultant to do a refugee status thing in order to get another work visa, some of you may know who I´m talking about... She wasn´t forced to leave, we left within the 30 day thing. So there´s a bit of history for ya.
Ok so, the questions.
#1 The Canadian government website and sponsorship application guide (in the guide to immigration) state:
You (meaning the principal applicant) and your family members, whether accompanying you or not, must undergo and pass a medical examination in order to come to Canada.
and
If you and your family members who are 18 years of age and older and are not permanent residents or Canadian citizens have to provide:
a valid police certificate, or
police clearance, or
record of no information.
Ok so we are here living with my wife´s mother and brother. Do the above mean that her mother and brother need these police documents and medical exams? A lawyer has said that only my wife needs to do these things, not her mother or brother. Just want to make sure about this.
#2 Sponsorship eligibility. In order to sponsor, you must… prove that you have sufficient income to provide basic requirements for your spouse or common-law partner’s dependent children. To do this, you must provide documents showing your financial resources for the past 12 months. This requirement applies only when dependent children who have dependent children of their own are included on the application.
We are kinda freaking out about this because to us it isn´t exactly clear. Like I said before, my son and I have been here in Mexico with my wife for over a year (since she left Canada..), I haven´t been able to work (only know a little spanish) and my wife has only worked a bit, which was horrible for our son so she stopped. We have no funds saved, in Mexico or Canada. So is this financial thing going to be a problem? The best I can do is maybe get a letter from my brother in Canada stating that we can stay there until I find work. Advice?
#3 Due to my wife having the deportation order, she´ll need an ARC (authorization to return to canada). I understand that it will automatically be done at the end of the sponsorship application if she is approved for her PR. Just want to hear from someone that´s been through that to know for sure that´s how it goes.
