Questions about sponsoring a partner from Cambodia.

I am looking to sponsor my partner who I now live with in Cambodia. It is my plan to return to Canada before her to start a job. Is it better to wait and apply for her immigration when I get back to Canada. I am wondering if my move would throw a wrench in the tire for the process (I know how finicky government applications can be).

Another question I have is whether my partner is considered a common-law partner or a conjugal partner. I am now currently living with her and I have been since January 2020 (> 1 year). It seems that our partnership would be deemed as a common-law partnership but there is no option under outland sponsorship for a common-law partner on the application I am filling out.

Common law not conjugal. You can apply before returning to Canada and then update your address to Canada. If you apply while still abroad, you'll have to show intent to return to Canada. If it's a short period of time may be easier to apply once already back in Canada.

Make sure you have good documentation to show the period you lived together particularly the start date.

Also, would she still be considered a common-law partner if I waited till I went back to Canada to apply?
