I am so confused now, in their it says, if assited by others you cannot claim spouse. Her father only paid for food that's it nothing else. I give her money to buy clothes and other living nessceties. I am very confused. I entered in the software 0 and it is giving me a boost. Please help

Only advice I would give here, is talk to an accountant experienced with claiming spousal amount for a spouse you are not currently living with.

hello,
I got married last year in April 2014 & immediately i updated my status on CRA Website. I am a Permanent Resident of canada from last 3 years. I tried putting 000 as her SIN number on my Turbotax software ob my Ipad it won't accept. I spoke to an accountant at H&R block but she said that i will have to speak to CRA. I called CRA & they said that i should try speaking to the Software company who makes Turbo tax. I am really in dilemma now. My wife is still in India with my family & she is not working at all since we married. I have been sending money to her through my dad's account because she has Nepal Citizenship & cannot open an account in India. How should i proceed??? Please advice.
Step by step advice be highly appreciated.. Thank You

Step 1 - Contact an accountant who's experienced in spouses that are not living in Canada with you.

If your family is providing room and board for your wife in India, you may find that even if you are sending money CRA may not accept it as suitable reason to claim the spousal amount. You really need to talk to someone with lots of experience in this area.

Thank you very much for the information. I live in Vancouver so is there anybody who knows an accountant who can help in this regard. Any leads will be appreciated.

When you marry a non-resident spouse, your spouse is then considered a resident for tax purposes because they have significant residential ties to Canada by being married to you. You must claim their world income (convert their salary in their country to Canadian and put it in the other income box for their income).

My common-law spouse just used TurboTax to e-file a few days ago and the program DID allow him to use all 0's in place of a SIN for me when he claimed me as a dependent. I actually sent off an application at the beginning of February for an ITN, but was rejected and told to go apply for a SIN. I only just now applied for Family Class Outland in January, so I don't qualify for a SIN, however, I am a tax resident since I was in Canada for more than 183 days in 2014 and having a spouse here, have established ties. I called the customer service line and explained and she said I'd have to resubmit with a letter explaining my status (I think they were confused). I just got that 2 weeks ago, so I'm out of time this year. :p Hoping I'll actually have a SIN by this time next year.

That is not always true, it depends on many factors including whether Canada has a tax treaty in place with the other country. It is never automatic. In many cases the non-resident spouse needs to remain a non-resident to the CRA also and not count their income. Due to complexities of residency rules it really is better to talk to an accountant to be sure.

You really should call Canadian Revenue Agency to get the correct information as some accountants unfortunately are not giving the correct information . Better to absolutely sure when it comes to income tax in case you get an audit.

Correct about the tax treaties. In my case, the country of my husband didn't have one.

Recent reports have shown in some areas CRA is wrong 25% of the time (1 in 4 calls get wrong information). Only call CRA when it comes to simple matters. The call centre agents are not trained in the complexities of non-resident spouse claims to give accurate info. Experienced accountants will know more here.

Same with CIC, often they give completely wrong info over the phone when you call and ask.
