Question on FOIA results

So I finally something (?) on my FOIA request which was submitted January 430, 2015. It's an email saying:

Thank you for your patience. A search of CBP databases produced records responsive to your Freedom of Information Act (FOIA) request

CBP has determined that the responsive records are partially releasable, pursuant to Title 5 U.S.C. § 552 and have applied the appropriate exemptions.

You have a right to appeal our withholding determination. Should you wish to do so, you must send your appeal and a copy of this letter, within 60 days of the date of this letter, to: FOIAAppeals, Policy and Litigation Branch, U.S. Customs and Border Protection, 90 K Street, NE, 10th Floor, Washington, DC 20229-1177, following the procedures outlined in the DHS regulations at Title 6 C.F.R. § 5.9. Your envelope and letter should be marked "FOIA Appeal." Copies of the FOIA and DHS regulations are available at www.dhs.gov/foia.



Can anybody decode this for me? what does this mean? Where can I see my FOIA entry/exit results?

You need to login to your online FOIA account and then click on the FOIA request that you have submitted and scroll down to the bottom end and you will see the records as a PDF attachment. Download the attachment to check your FOIA records.

Oh I found it thanks! I had made an account for the second request and that worked.

I didn't make an account for my first FOIA. But I submitted a second FOIA later and created an account for that one. The results were from the second request, so I found it when I logged in. Thanks for your help.

I also have the same problem. I requested FOIA two months ago and nothing happens when I click on the link. Seeing your messages, I realized I also did not create an account. Created one now and want to submit a second one. Can you please tell me which Agency and sub-agency you chose? Thanks guys

I just got a message regarding my FOIA request. They closed it because of the following reason(S):

Your FOIA request has been closed as insufficient for one or more of the following reasons:

· Your FOIA request is a third party request and did not include authorization that information on this individual can be released to you. All third party FOIA requests must include a signed G-28 or G-639 form, or a signed statement from the individual verifying that his/her information may be released to you.

· Did not include a date of birth.

· Did not include a full name (and aliases as appropriate) of the individual in which you are seeking records

· Did not include a death certificate (or other proof that the subject is deceased)

· Did not include a clear and detailed description of the records being requested.

Please resubmit your FOIA request, along with the required information, by logging into your existing FOIAonline account or go to xxxx to create an account.


I did not include any form in my application. Just wondering which form did you guys include?

In addition to that, please upload the photocopies of the biographical pages of all your passports along with the scanned page of the visa sticker that you have used to enter USA.
That way CBP will get your name, date of birth etc in order to do a search.
You need to mention your address, passport number etc in the fields as well.

I'll certainly attach the scans as you mentioned. I am wondering if you guys did fill out one of those forms as well?

Also in the form G-639, there is a filed about I-94. I don't have any information about my I-94 as the officer at the border removed it from my passport when leaving the US. Do I need to fill this out necessarily?

All I did was the following. I think you missed writing something that's why your request was closed. I haven't used any of the forms except the following:

Log on to your account and submit a new request as follows:

Click on "Make a FOIA Request" (On the left)

Enter Agency: U.S. Customs and Border Protection

Enter your complete name with your address in the "Contact Information" section.

Under "Additional Information" please select "Types of Records Requested:" as "Entry/Exit" . Rest of the parts in this section are self explanatory.

Type "$25" in Processing Fees.


In "Description" please write in your words that you require your entry/exit records including date,time,port of entry etc and write the following information as well:


First name:
Last name:
Date of Birth:
Nationality:

Passport number(s)
NEXUS Card Number
VISA Sticker Number:

etc etc

"Request a Fee Waiver" and "Request Expedited Processing" are self explanatory thus select the drop-down options accordingly.

Under "Attach Supporting Files"

Upload the biographical pages of the passports that you have used to enter USA.
Upload the copy of visa sticker
Upload the copy of nexus card.

Thanks thecoolguysam for your detailed reply. This is exactly what I did last time. The only part that I did not was attaching the biographical pages and copy of visa stickers. I'll do this and update you on how it went. Once again thanks for your help.
