I am currently preparing to apply for inland sponsorship (common-law). Almost all the documents are ready, but there is one document I am not sure whether I need or not. A letter of explanation for the following situation:
My situation is that after filing my taxes this year, I received the Notice of Assessment and then realized that I forgot to update my marital status to common-law. After discovering this, I immediately contacted the CRA to inform them of my situation and told them that I wanted to change it to common-law. The CRA asked me to write a letter explaining why I want to change it and the reason I forgot to make the change, and to include my own and my partner's information with it. I have done so. My partner updated his marital status to common-law in his tax return.
I have prepared the IMM5409 form (since I will need it later for the SOWP application, I prepared it in advance). On my IMM5409, I have checked the box 'Declare common-law under the income tax act.' (When I went to get it notarized, the Notary Public said I could check it). I am now worried that if I mention this in the letter of explanation, it might backfire or cause unnecessary problems. However, I also feel that I need to be honest about it. Not sure what to do here, appreciate with any advice.
