Question 2 on IMM 0008 asking about `Alias' name

I'm in a healthy debate with someone regarding this question and would appreciate your opinion:

Question 2 on the Generic form asks if the applicant "has used a nickname, maiden name, alias, etc."

What if a person has simply used their middle name (in the past) in place of their first name, yet both names appear on their passport, as well as on their birth certificate.


Would that constitute using an alias?

No, I did that on a similar paper work and they said it's usually for artists etc who go by a nick name like Madonna or Shakira haha

Assuming that the person looking it has a hint of common sense, then you wouldn't think you would have to include it. As this is not guaranteed, if I had used my middle name on official documents etc...that might come up in checks etc...I would note it as an alias name. Just my opinion.

My opinion is that using a middle name is a legal alias, but it is still in fact an alias and should have been listed on IMM 0008.

The bigger question... is whether or not CIC would see that as misrepresentation by failing to do so.

I would tend to agree with you on this. As someone who has access to credit checks in their working life, I see this time and time again being used by people to gain further credit. It's obtained by using "legal" alias middle names as first names.

I disagree if i used a completely different name that was not on any documents then thats what i call an alias .For instance for many years i wanted every one to call me zowie lol .My mother has used her middle name all her life .Even on passport ,citizenship sin # etc .

It was the American Embassy :D
They have the same question there for a visitor visa, and instead of Maria I'm usually called Mary so that's what I wrote. They laughed and told me about Shakira :D

Hmmm...interesting.

I still don't see how a legal alias is NOT an alias.


We're also debating another issue regarding question 6 on IMM 5669 that asks if the applicant has ever been convicted of a crime or offense.

A person receiving a ticket and appearing before a judge, entering a guilty plea, has in fact been convicted, right?

Most people tend to equate `conviction' with `being arrested' first, but I don't know that CIC sees it that way.

This seems to be a big grey area from what I've read. Like in the UK you can receive fixed penalty notices for a range of offences. You pay the fine and don't go to court. Even though these don't appear on a police check should you declare these? There not an admission of guilt. But if you don't pay the fine and it goes to court, then it seems that these should Definately be declared. It's a legal minefield.

Now that is what i would call an alias .Mary doesn't appear anywhere on legal documents .

It seems to be a very BIG grey area!

Personally, I think that anything other than appearing before a judge (even without an arrest) and admitting guilt is NOT a conviction.

But at the same time...if a person chooses to fight a speeding ticket and is in fact found guilty before a judge...would that person have been `convicted' in the sense of question 6 on IMM 5669?

If the person had simply paid the fine (by mail) and never stood before a judge...would that have changed anything regarding question 6?


I'm going to suggest the person (that I'm debating with) simply submit a new IMM 008 and IMM 5669 (since they have not yet received AIP) so that they can be assured of not being found to have misrepresented themselves.

If i had to put down all my speeding tickets they would have a long list. Personally if i wasn't arrested and din't appear before a judge then i wouldn't write it down . Now my husband got arrested 21 years ago and it still came up on his police report .Any arrest or conviction in any country appears on a U.K. police report and stays on it till you are 99 years old.It will how ever have no live trace , but we still the sent an explanation and court documents along with our application. Speeding tickets , parking fines, any thing he did not get arrested for or appear before a judge we didn't admit .Now saying that we don't have our corp yet so we will see.

I actually called CIC about this because I have not used my middle name since grade school. It is listed on my birth certificate but it shows no where else in my life (including my passport only FIRST . LAST)... They told me a middle name is NOT an alias and I should leave it blank.
