I got my PRRA application today, I got refused as a refugy. My husband send the sponsorship application last week. I am afraid to come back to my country. I have a Down syndrome doughter and she is Canadian (2 y.o). The officer told me that the PRAA decision will be ready sooner than the sponsorship and they may ask me to leave Canada, she said that they can not deport my baby but they can deport me. I hear that the domestic violent doesn't have much succeful. I am not going to separate from my baby she need me. Please some body can help me?. How long usually take the PRAA decision?, haw long it take the sponsorship decision?.Now I have a job I am doing volunteering job at the library and I have new and "safe" life here with my own family.

PRRA: 2-6 months (if no new evidence is send)

Inland Sponsorship: 10 months - up to 2 years (it all depends of each case)

In yours, it will take long. It will be send to a local office and then most likely you guys will attend to an interview for first stage approval. After that another 3-6 months for landing interview.

The only chance you have with your inland application is that you have submitted it before you were called in for the PRRA interview. In that case you PRRA will not be on hold until a decision is made in your sponsorship application.

If you served with the PRRA before you sent your inland application, would be better idea to withdraw it and apply outland.

I f you have submitted a In Canada Spousal Sponsorship will defer your removal if it was submitted prior to being called to the Pre Removal Risk Assessment (PRRA). Submitting a In Canada spousal sponsorship after attending your initial PRRA interview will not defer your removal.


So did you went? What happened?

Hi Gigi

I had such a stress that you can't imagine..... I send my application for PRRA and now I am working in my writing submission.... With my poor English...but my husband will read this. I don't know what will happen but thank you so MUCH for respond me. We made a "Claim of Right" I don't know if you know about it. We going to send it with the PRRA, my husband said that it will help. I will write any information further. Thank you again.

I send my sponsorship application before the interview for the PRRA, so you mind that they will wait for the sponsorship decision? We didn't have money for lawyer so we did it our self. thank

If you sent your sponsorship application before been served with the PRRA, then CBSA won't open your PRRA until CIC make a decision in your sponsorship application.

Hi

Well, when I had my interview the officer told me that the result of PRRA will be before the Sponsorship and if is negative I have to leave the country..... I am so scare!! What I going to do with my baby?? but if it is in the Manual like Gigi said I will feel much better. This Friday is my last day to present the PPRA. We will see. After that We are just praying....

The Canada Border Services Agency has agreed to grant a temporary administrative deferral of
removal to applicants who qualify under this public policy. The deferral will not be granted to
applicants who:
• Are inadmissible for security (A34), human or international rights violations (A35), serious
criminality and criminality (A36), or organized criminality (A37);
• Are excluded by the Refugee Protection Division under Article F of the Geneva Convention;
• Have charges pending or in those cases where charges have been laid but dropped by the
Crown, if these charges were dropped to effect a removal order;
IP 8 Spouse or Common-law partner in Canada Class
2006-10-16 60
• Have already benefited from an administrative deferral of removal emanating from an H&C
spousal application;
• Have a warrant outstanding for removal;
• Have previously hindered or delayed removal; and
• Have been previously deported from Canada and have not obtained permission to return.
For those applicants who are receiving a pre-removal risk assessment (PRRA), the administrative
deferral for processing applicants under this H&C public policy will be in effect for the time
required to complete the PRRA (R232). Applicants who have waived a PRRA or who are not
entitled to a PRRA will receive an administrative deferral of removal of 60 days.
Applicants who apply under this public policy after they are deemed removal ready by CBSA will
not benefit from the administrative deferral of removal except in the limited circumstances outlined
below (transitional cases)."

hi gigi, i have a similar situation where we've applied for sponsorship before my husband got denied refugee and before the PRRA, does that mean we qualify for the above info where he can stay until the sponsorship is processed?

Hello guys, I was in the same boat like you, when I was in Canada I was as refugee, I got married with my husband and 1 month later my refugee appeal was refused I mean PRRA , the officer who handled my case told me I have to go to backhome and wait for my sponsorship application but outside from Canada, however I did it to avoid problems just I want to be as soon as possible with my husband, my application is still in process, and now my visa office is requesting me an ARC because they said i was deported, it is not true I left Canada before the date that Refugee Service Board requested, when they took my decision for PRRA, they told me I have to left Canada before MARCH 7 and I did it on MARCH 5 i bought my own ticket, verifying my departure with an officer at the airport, people in this forum says it is because of I did not leave Canada when they refused my case from the first hearing without appeals but i did not receive any order to leave Canada only for appeal ,my departure cerificate said DEPARTURE BECOMES TO DEPORTATION why??? i really dont understand now I am so worried because I dont know if my visa office will approve ARC I sent them all my documents to prove I was not overstay and I complied with the law in Canada I sent them copies from documents with appoinments for my refugee case where they can see nothing was wrong.. What do you think guys, this is really hard!!!

Yes. You could benefit from the above rules, if you have submitted you sporsonship application before benn called in for the PRRA interview.

When I went to the PRRA interview I was told I would have to leave Canada once the PRRA redeems a decision. The officer told me, only if the PRRA takes longer than the sponship I would be ok to remai n in Canada. according to PRRA time frames, that di not seemed posssible to me. So I was pretty dissapointed bjut then I made a little research over the web and I found out that they were lying to me. Once you have applied for sponsorship rior a Prra interview you get to stay in canada until the sponsoship application gives a decision. If it's positive you became a permanent resident. If it's negative your PRRA application package is open and after 2-6 months they will ive a decision and if that is positive yoiuy becamo a permanent resident and if it's negative thenyou get aske to leave canada

o in your case that happenend when your appeal was denied.

Nothing to worry about. Mzany people had left Canada in similar cirscuntances than yours and once they hgave prove to CIC they are genuine maried to a Canadian ctizen then they get sponsorship aPPROVAL AND ARC and they get entry in Cnada as permanent resident.
