Hello everyone,
I have spouse VISA case going on right now.

My pp is with the new delhi embassy for past 2 months. I had canada student visa refusal in 2006 where they said that i will not return back and i dont have sufficient funds.
In 2010, my visitor visa was refused and reason was stated that I would not return back. I had to visit my cousin sister's marriage.
I contacted embassy and they are saying that they are verifying the previous refusals that why they were refused and thats why its taking time.

My wife is from canada and I am from India. I suppose my spouse PR visa application does not relate to the previous refusals then why CHC ND are checking my previous refusals and investigating on it?
 
I guess they are checking that since you have tried twice before to get to Canada and failed, that you are not doing anything possible to try and get in, i.e. MOC.
 
You have a history of failed attempts to enter Canada, so your spousal sponsorship is under additional scrutiny. Expect to have your marriage, even if it was arranged and conducted according to custom, suspected of being just another attempt to gain status under IRPA, and be prepared possibly to be interviewed if any doubts arise from the review.

i do have another question.
they also asked for my old passport which i sent but it was made in 1993 and expired in 2003. it has my year of birth wrong but i have no travel history on old pp as well as on new passport. i sent an affidavit with copy of my birth certificate to explain that old pp was never used and it had wrong date of birth due to clerical error but that was corrected when new pp was made.
Will it cause any problem?
 
Hopefully it should be enough that you included the affidavit, and the new PP agrees to the birth date on the birth certificate.
