:-\I have known about the changes in the Canadian law only few days ago, and Like the rest of us, I am so full of rage and anger,,,,the rest of my family are even in a state of denial. I , however , keep thinking that we might have our share in this situation. So I Just wander:
1- Is it our fault that we over trusted the Canadian government and had endless faith in its integrity?
2-Is it our fault that we did not feel suspecious about this situtation even with waiting times between 5/8 years?
3-Is it our fault that we did not try to sue the Canadian adminstration earlier becuase of the extraordinary processing times?
4- Is it our fault that we took the legal and ethical path to come to Canada, and wasted 1000 chances to land there illigally and stay forever?
5- Is it our fualt that we believed , trusted, respected and hoped?

For the last 2 years of my waiting time, I had thoughts that something must be going wrong,,,but I used to dismiss these thoughts immediatly,,,,,I used to tell myself that we are dealing with a government not an agent or a firm and that a countery like Canada must hold its legal and ethical commitment to consider my application. I was not alone,,,,,thousands upon thousands of applicants must have had the same thoughts.
Had I acted earlier ,,,,had we made any action before this law was imposed!!!

extracts from a recent judgement:

Canadian jurisprudence has long recognized that Ministers have an obligation to perform their legal duties in a reasonably timely manner. This legal duty has long coexisted with the understanding that Ministers are accountable for the management and direction of their ministries and have the authority to make policy choices and to set priorities. These two seemingly conflicting propositions have been reconciled by according the Minister considerable leeway in determining how long any kind of application will take to process, based on his policy choices.

However, for those that are determined eligible for processing, the duty to do so in a reasonably timely manner remains, absent clear legislative language extinguishing that duty. The Ministerial Instructions inform the assessment of whether that duty is discharged in a reasonable period of time.
