PR validity/ expiry rules

Dear All,

Just a couple of questions.

1) Due to some personal reasons, I will be spending only my LAST 2 years (out of the provided 5 years valid PR) in Canada. At the expiry of the PR, how do I renew the PR. First of all (being spent only 2 years), am I eligible for the renewal ? If yes, on what basis do i claim my renewal ? Should i need to go thru the painful points-system again ? or how is it ? Should I need to be out of Canada till the renewal gets thru ? Is renewal a lengthy process ? Please advice.

What would be the validity period of the renewed PR card ?

If it gets renewed successfully and if i live for 1 more year, am i eligible for applying for the citizenship or canadian passsport ?


2) I got my PR & finished my landing formalities on 15th Aug 2010. So, the PR card validitiy is upto 14th Aug 2015. I am rite now in United States. But due to personal reasons, I would be moving permanently to Canada only by Jan 2013 . Am I eligible to make the entry and live there ? or would my PR gets expired by then, as i would have stayed OUTSIDE atleast 2.5 years by then ? Please advice.

Hello.

1) To be eligible for renewal you need to have spent 730 days (exactly 2 years) total in Canada during the 5 years proceeding the date of your landing. I do not think you have to go through the points system again, but I am unsure of the exact renewal procedure. You probably need to kick it off some months before the 5 years is up.

2) Your residency status does not expire until 5 years after you landed - i.e. August 2015. If you settle in Canada in January 2013 and stay until August 2015 then you will have completed over 2.5 years of the 2 year requirement and therefore will be eligibile for renewal.

Hi,

Kindly advise on the following situation

1) I became a Permanent Resident on 11 March 2010 and stayed in Canada till 21 April 2010 (43 days)
2) My PR card expires on 15 April 2015
2) I plan to travel back to Canada permanently by 31 Aug 2012 (i have been out of Canada from 22 April 2010 till date).

so my questions are

a) will i be able to re-enter Canada without any problems on 31 Aug 2012?

b) Will i be able to apply for citizenship after having renewed my PR card and accumulating the remaining days on the renewed PR card?

c) Will the CIC consider the days from BOTH my initial PR card & the renewal PR card towards citizenship or will i have to re-accumulate 1095 days on my renewed PR card to apply for citizenship?
(PLEASE CLARIFY POINT (C) AS I HAVE READ A LOT OF UNCLEAR INFO ON OTHER BLOGS AND WEBSITES)

Thankyou for the prompt reply.

I have checked the residence calculator already however this is the part that i get confused

The 4 years preceding the application date will be taken into consideration in which the applicant should have accumulated 1095 days (3 years) residence in canada.

Again, i wanted to specifically know if i complete only 2 years on my first PR card...then after i renew the PR card for 5 more years in 2015...can i only complete 2 more years before applying for Citizenship or do i have to complete 3 years + 1 more year before applying for citizenship

You help to clarify my confusion will be greatly appreciated

you have to maintain PR status thats the 2years from 5years.
you can apply for citizenship after spent total 4years but maintain PR status to become a PR.
