PR for parents, medical request, one decided not to come

Hi

My parents' application is at the stage that CIC requested for Medical Exam. My father is too old and he can not make it. He decided not to get the PR and I want the application continues for my mom only and to withdraw my father. I wonder if I should send a letter now and request withdraw for my father, or just send one medical exam for my mom? What will happen next?

It's mandatory that both of your parents complete the medical - even if you are just sponsoring your mother. If your father doesn't complete the medical or if he takes the medical and fails it - they will both be refused. In other words, your father must pass the medical in order for your mother's visa to be approved.

As of now, your mother is going to be refused since your father hasn't taken the medical.

Correct. Both parents MUST take and pass the medical exam, no matter who is accompanying or not.

You can't withdraw your father from the app. You can only change his status to non-accompanying, but he still needs to do a medical exam.

This rule is in place to prevent people with serious health conditions from skipping the medical exam, and then being sponsored for PR later as a spouse where there is no excessive demand criteria for medical.

The only way for you to do (it is very cruel though), is to ask them to divorce. As a result, you can sponsor your mom alone.

That most likely won't work. CIC will very likely classify it as a divorce of convenience entered into primarily for the reason of facilitating the mother's immigration to Canada - and avoiding the medical for the father. It will be extremely suspicious to them that OP originally sponsored both parents and now they are suddenly divorcing. The only real option is for the father to complete and pass the medical.

My parents are actually separated for 3 years now (not for immigration purpose). They are not legally divorced but they have enough document to show that they leave in different city for last 3 years.
Does this help to waive my dad's exam without rejecting my mom.

Was the 3 years separation not mentioned in the initial application?

You can provide all this info and evidence to the visa office and ask that your dad be permanently excluded from the application. Your mom would also need to submit an affidavit that she understands she will never be able to sponsor him for PR ever in the future.

The visa officer may allow this, or they may not. It's entirely up to them.
