Hi All,

I have gone through the forum inputs and wish to discuss my case with you all and want your important advise.

Myself, my wife and our son, we landed in Toronto, Canada on 25th September 2008 and left back to our origin (Qatar) after 22 days. Since then been planning to go back to canada after resigning by coming September this year, as per the Resident permit rule of 730 days. In september 2009, we also had our second child, but he doesnt carry any RP until now. We heard of visitor visa, what can be applied with the consulate in abu dhabi. May be it is also called TRV, not sure about it.

The employer for whom I work insists me to work until Dec 2011 and leave. I dont know whether this is okie, coz 15 Oct 2011 is deadline to reach back to canada.

Also, if my family joins me after I go to canada, lets say, 2-3 months, once I get my second child sponsorship papers ready and approved, will it make any problems for them to renew their RP at later stage.

I heard that if a partner works for a canadian company outside canada, he or she is exempted from 730 days rule, is it right, pls advise.

You might have a problem getting a TRV for the child because the intention is not for the child to go to Canada temporarily. If you are refused, you can apply for a TRP, a special permit for the child to go to Canada anyway. If you are refused for that too, what remains is for you or your spouse to go to Canada alone and to sponsor the child before the rest of the family can join. Since all this takes a while, I would recommend that you do not wait until October to do this.

If you or your spouse were working for a Canadian employer in Canada and have been transferred to another country, then your time outside Canada will also count towards your residency requirements but it doesn't sound like that is the case with you.

To avoid problems when renewing your PR card if you are short on the residency requirements, you should simply remain in Canada, let it expire and not apply to renew until you have your 730 days in Canada. They will only count 5 years back from the date of your renewal application.

Dear Leon, thanks for your advise, really appreciate.

Just wish to ask, if lets say instead of going by Sept-2011, i postponed it till july-2012, next year. Going by that time, will that effect my and my family RP renewing process at later stage. During this time, I can also go and apply for my son and by the time we go, he will also have his RP in hand.

Not going in Sep-2011, i will be overstaying 730 days, means by july next year only 500 days will be left. Pls. advise.

If you postpone until July 2012, you will be unable to meet the residency requirements for your first 5 years as a PR.

It is possible that immigration will become aware of this or may suspect it as you try to enter Canada and will report you in order to revoke your PR. If that happens, you will be able to appeal but without good grounds, you will lose. Immigration does not consider it good grounds not to meet the residency requirements that you have a good job elsewhere.

As for sponsoring your child when you yourself do not meet the residency requirements, I honestly do not know if they check on that for sponsorship. Maybe they do, maybe they don't.

I think I better move to canada this year by September end, before that I have to apply for my second child TRP, if I succeed ok or unless I have to reach canada and apply for him.

Pls. advise, what if my family(my spouse, first child) they come along with my second child later once they get my second child RP papers to land in canada. Will they find difficult later at RP renewal stage ??

I work a an administrative assistant with an Oil & Gas Company here in Middle East, will I find easy to get a similar job in Canada ?? how is the job market. Do you have any advise for me.

If they must wait in your home country with the baby, they will end up not meeting the residency requirements. If they get into Canada without any problems, they can simply wait and let their PR cards expire and not apply to renew until they have a full 730 days in Canada in the previous 5 years. If they have some problems, even if they lose their PR's, as long as your PR is safe, you can always sponsor them back.

Hi Every One
My family PRC will be expire in Oct.2011 and we will be eligible for Canadian citizenship in September 2011. My few friends told me that Canadian citizen ship process completed around 8 to 12 months. But my family have plan to visit out side Canada in between Oct.2011 to Dec. 2012.
Please any body can tell me how I can renew my family PRC.

You fill out an application and mail it in. You can find the application here: http://www.cic.gc.ca/english/information/applications/prcard.asp

The processing times are currently around 119 days, see http://www.cic.gc.ca/english/information/times/perm-card.asp so that is about 4 months but you want to travel in 3 months. You should therefore ask for expedited processing and to do that, you follow the instructions here: http://www.cic.gc.ca/english/information/pr-card/apply-how.asp#urgent
