Hi All,

I was charged DUI when on work permit in 2009, but now got my landed status in July 2010. Now i am a landed immigrant (permanent resident) in canada. I was charged with a DUI over 80 in Toronto. My case is for trial in a month now. If i get convicted, will i be deported ?

What are my chances of staying in Canada ?

I have a valid US visa but can i travel to US normally considering DUI is not a criminal offense in the US ?

Please please help! Thanks!

DUI is very much a criminal offense in the U.S.; as far as I can tell, .08 is the legal limit in every state. I have no idea whether your visa is contingent on your not being convicted of a crime, but if it is, you may have trouble entering the U.S.

I hope for your sake you have a lawyer.
 
How did you get PR status with a DUI on your police record?

Normally, Canada would not grant you a PR unless you had been rehabilitated after 5 years the crime was committed.

If you lied about this and it becomes apparent in your new charge, then I am afraid Canada will revoke your landed status.

Get a lawyer fast.
 
I was given the permanent residence visa stamp in Nov 09, but i was scared to do the landing for the fear of getting deported at buffalo, i waitied and got an appointment to land within the country in Toronto, which i did couple of weeks back. the officer asked me if i was convicted of any crime, i said i was charged but not convicted yet, the officer heard the case and let me get landed, i don't know the reprecussions but i didn't lie. I hired a criminal lawyer but he falied to do a bargain from the prosecution, he makes me feel i didn't make the right choice in hiring a good lawyer, because a couple of ppl i know who got DUI got away with a careless driving ticket on highway kind of things and a huge insurance cost plus licence ban fro an year with fine of 2000$, atleast they didn't get branded as criminals....

have my trial in a couple of days.. will keep you guys posted, but if any one of you know anything related to permanent residents with DUI conviction please contact me, i need your help,,PLEASEEE
 
If you're convicted, I wouldn't be surprised if you end up subject to a removal order. You need an immigration lawyer, now.

I have seen your comments on numerous forums. Are you a DUI attorney? I have spoken to numerous people with much more serious offences than a DUI, and they were granted PR in Canada. In the USA a DUI is NOT automatic grounds for being denied acces to the country as a tourist. In Canada, they turn people around all the time for 40 year old arrest for disturbing the peace. Overall, Canada's system is DRACONIAN, as it is the only one of its kind in the world. The Canadian government is basically telling Canadians they can fall in love with any one they want from another country, but if they have any minor offence, too bad. I'm not condoning DUI's but if you think every person with a DUI is a danger to the community you are living in dream land, in fact tiny portion are dangerous, and any properly trained official could spot them a mile away.

The US has at least one area where is it draconian as well - drug policies. If you're charged with pot possession over a personal use amount (personal use = 30 grams) you're automatically inadmissable for life and can't be sponsored by your spouse ever. This means that someone who was stupid and 19 and got caught with 40 grams is out for life. I think that's a bit insane...
