PR application (PNP) and my wife dual intent concern

Hello everyone,

First of all, I appreciate the help of dedicated users in building such a great community.
I have a question and I searched the topics but I could not find a similar situation...
Let me explain my situation:
I have recently graduated form a university in Ontario in Graduate level and applied for PNP Ontario.
My wife joined me here in Canada recently (8 months ago) under student permit and visa, 4 months after she came, I graduated from university and applied for Post Graduate Work Permit for both of us and obtained it for 3 years.
My wife (with a student visa valid for 2 years, study permit valid for 2 years, and work permit valid for 3 years) could not not register to university and is currently passing prerequisite ESL classes.

We received our Provincial Nominee 3 weeks ago and applied for PR!

now I have 2 concerns:

1- Is there any problem for my wife to re-enter Canada (her Student visa is multiple) given the fact that she is not registered with the university. Is it possible that the boarder officer question her why she is holding a student visa and a work permit?

2- I have just heard a friend of mine talking about dual intent. She was saying that my wife's intention was to temporary study in Canada and leave and we should not apply for our PR before her completion of study... Is she right? if yes, what is the solution?

hi Sanosun,

Can you first clarify, what type of studies is your wife pursuing? ESL or University?

She Dear jbrown,

My wife is on her study permit for post-secondary education (master level) at university of Carleton. But she had a language condition on her admission and she is attending ESL classes outside of the university (you don't need additional permit for ESL classes)

Hi again Sanosun,

Yes, I'm aware that with a study permit one can study ESL and later a post-secondary program. I asked the question because your post is a bit confusing. If your wife is not enroll in University yet because she has not met the language requirements imposed by the Univ., that means that she's an ESL student so how was she granted a 3 year work permit?

Correct me if I'm wrong but ESL students are not eligible for work permits. How did you manage to get her a work permit and what type of work permit did she get, open or closed?
