Hi there,

I was just wondering if anyone could give myself and my girlfriend some advice with regards our situation. We're both from Ireland and our initial work & travel visa's expire on December 26th. We're eager to get extensions, and thankfully my girlfriend has a full-time job so we are hoping to apply for an LMO and permit extension through her. We haven't started the process of attaing an LMO, but will be within the next week.

Our question relates to the actual visa processing times itself - assuming we get an LMO granted, we are told that we have to wait approximately 85 days for the processing to take place when this is mailed to the relative visa office.

However, is it true to say that if my girlfriend went down to Niagara Falls, crossed over to the U.S and returned again, she could get her work permit extension there and then? As her common-law partner, would I need to go with her too as I too will be looking to get a work permit?

I have heard a case or two of people getting rejected at the border, and thus only allowed back in on a visitors visa - if we go down before the expiration of our initial work permit on December 26th, can we be let back in to the country and be allowed to continue working?

Your help would be greatly appreciated! We are not too concerned if we have to go through the process of waiting and mailing our visa's, but the main reason we want to get it sorted sooner rather than wait and go into implied status is because we want to go home to Ireland for Christmas, but could not leave the country and come back in to work whilst in implied status, and so we were hoping that this option of actually get us sorted sooner and we can enjoy Christmas with our families!
