Hello there,

I am applying for my post-graduation work permit. My wife came with an open work permit during my studies and she applied for a study permit last year and was granted. The only thing is that we had a baby, still in Canada of course, and my wife won't be able to study anymore. So, on my application, there is a section where it asks what my wife wants to do in Canada, and these are the following options: apply to stay as a visitor, apply or extend work permit, apply or extend study permit. I decided for her to apply for a work permit (this will be an open work permit). Is this ok? Even though I haven't received my post-grad work permit yet?

Also, I have been working with a company for a year now cause I got an off-campus work permit during my studies. Should I add an offer of employment, even though I am already working? I believe I do not need a Labour Market Opinion, as I am going to be working with a PGWP.

I am still going to add prove about our Canadian baby.

That is a tricky situation though i don't know why CIC has made it complex for people who come here on study.

Probably worker was the right choice you made for your wife, but i think you should submit your job offer along with enough details to prove it is NOC 0, A or B.

The reason for this is, you got your spouse visa when you were a student. But when you become a PGWP holder, your spouse can only get a SOWP or trv or S study permit if you are also holding a NOC 0, A or B job as well.

You might be okay since you are already working assuming your job qualifies one of the NOCs, but submit your details asap.

Mmm, and if she applies for a TRV, would she be able to stay with me for the whole 3 years? I graduated from a 4 year degree program.

Yeah that should be NOC B. But you should submit some document as evidence of role. To be safe with CIC, you should have elaborate role description proving you qualify that NOC.

And yes, the trv issued to family members of wp holders is different. It does not require you to exit every six months or any thing.

I got those for my kids so i know clearly. The trvs are valid equal to length of work permits of myself and my spouse.
