Hi guys,

My EE application was refused stating that I do not meet the fund requirements. The officer has mentioned about my Balance in Savings account and my PF account. He has not mentioned anything about my fixed deposit which consititutes about half of my fund requirements. The bank statement clearly mentions about my FD and even in my LoE I had explained all the 3 sources of funds. If the FD is included the total funds is about 1000 CAD greater than what is required by CIC.

I'm a AoR March 2017 FSWO applicant, Medicals passed. It's so disappointing to getca refusal 8 months after AoR

Anyone with a similar case as mine where you showed more than sufficient funds but still got refused or insufficient funds?

Fixed deposit are encumbered and not readily available funds though.

I can feel your pain, after 8 months is a really long time. I think you should transfer all the money in your bank accounts into one. It would make it easier for them. It seems the VO are not so patient these days in really vetting documents. Better safe than sorry. All the best.

Wrong. Fixed deposits are absolutely allowed and are shown as proof of funds by many. There must be some other reason or it is straight away thier fault not to consider it.

Help!

Four days ago I submitted my eAPR. I was looking at screenshots of the personal activities section of my application and just realized that I mistakenly entered the year 2/2015 to 3/2015 instead of 2/2017 to 3/2017. The months are correct, just the years are wrong.

Do I need to submit a CSE for wrong dates? or they will ask for it later

Thanks

First of all Let me tell you fixed deposits are always considered as POF. Sometimes PF is not considered as POF because PF cannot be en-cashed anytime, but it depends on which country you belong.

Mostly it seems to me the mistake from their side and you must send CSE as soon as possible.

Double check your PF account. Check the PF laws. PF may not be readily available fund.

Oh really? That's interesting. I didnt know fixes deposits were readily available. Also can you indicate where that form of funds are accepted because I didnt see it on CICs page : http://www.cic.gc.ca/english/immigrate/skilled/funds.asp

However the statement I did see was " The funds must be available both when you apply and when (if) we issue you a permanent resident visa". So was his fixed deposit "readily available" when applied for Pr? It can be Pf also but just going by whats stated onsite their site. Based on my understanding when something is deemed fixed it is locked and not "readily available".

So since your FD wasnt explicitly stated as unencumbered the officers judgement was solely based on the funds in your savings which was ultimately insufficient unfortunately. Thats why i didnt risk none of those deeds pf gifts etc. I had everything in cash because some VOs are rather inconsiderate.

Majority of my pof is in fixed deposit but while submitting account statement I did request my banker to include the fact amounts and he did mention it as unencumbered and available as and when required.

Your situation is slightly diff because the banker explicitly stated as unencumbered. An officer is only making a decision on your savings if your banker doesnt give explicit further assurance of other unencumbered..i repeat unencumbered READILY available funds.

There are a few fds that are for tax purposes and have a lock in date, but apart from this, fds are considered pof as it is assumed that when the applicant is moving base those funds are readily available. Since the applicant had mentioned the same in loe, it's mistake on part of ircc to reject on that basis.

Clearly in my case the officer has taken the PF amount into account for settlement funds. His/her comment explicitly adds the balances of my Savings account and that in my PF account and then says this combined balance of both does not satisfy the PoF requirements. I had explained in detail about this with the PF laws in my country in the LoE.

The officer has just not mentioned anything about my fixed deposit at all. To just confirm that it is unencumbered there is a column that explicitly says 'Lien = NO'. So he either completely missed seeing it (or) he deliberately did not consider is as past of my PoF which would be quite strange as I haven't seen any rejections because of this.

My FD is not a long-term FD used for tax purposes. It is just a 1-year normal FD without any lock-in. Though it has a specific maturity date I can withdraw at any point in time, just that there might be an exit load of 1% or so.

Have you ordered ordered GCMS notes? They must have concerns regarding your funds from the start. According to my notes funds were freezed at CAD 13265 on the day of submission and my latest notes still shows the same.
