Positive LMO led into Refused Working Permit

Hi Every Body,

Greetings from Indonesia.

I need your help guys.

6 months ago, I received a positive TFW LMO from my Employer to work as a farm worker in Ontario. Then I applied for a Working Permit but refused by the officer. In the letter stated that the officer is not satisfied that i would leave Canada at the end of working period.

Let me tell you my situation. I am an Indonesian, my father is a farmer and so do i, we don't have much asset. But the employer promised to help me out of my situation and i promised to leave Canada after 2 years working contract to support my parents.

Today, my employer sent to me a re-newed LMO and ask me to re-apply a Working Permit. I guess this is my last chance, otherwise no more extension to my LMO.

Please advise me guys what should i do before submitting my LMO to avoid refusal?
Do you think they refused my Working Permit request because of poverty?
Who should write the cover letter? Me or the employer?
Is there anybody ever have the similar experience?

I only have a short time to re-apply, I greatly appreciate any inputs from you all guys...

YOU are the only who needs to prove that you will return home after the end of your work permit (not your employer). You should attach any evidence you have that demonstrates you have strong ties to your home country and have no plans on remaining in Canada longer than the duration of your work permit.

If I bring my family documents such as family id or my son school report, would it be a strong evidence to prove? My son is 9 years old. Please advise.

It makes a strong case if you have family back in your home country i.e. son, spouse etc.

What kind of job will you be doing in Canada?

Is there a possibility for permanent residency to be sponsored by your employer? if so, try looking into the dual intent and use it.

When i was applying for my work permit 4 years ago I got refused twice because apparently i won't leave canada after my contract. Then I used wrote a dual intent letter stating that my employer will sponsor me to become a permanent resident and boom.. they granted my work visa on the 3rd time.

4 years forward, i just applied for my citizenship.

Just a thought. If you can qualify for the provincial nominee program or other programs that can grant you PR status later use it. When i work as a housekeeper there was the low-skilled pr program. after 9 months of working as housekeeper my employer can sponsor me to become a PR so i used for my dual intent. I pretty much told the embassy that after 9 month my PR application under the low-skilled program will be processed. But of course, I also told them that if it won't pan out ill go back.

So my suggestion is, look if there is a program that will help you become a PR and write them a notarized dual intent letter that you will apply as soon as you can to become a PR. then also support your claim that you will go back home if the PR is not approved.

It worked for me so maybe it is worth a shot for you.

+1 blestcheche. That was really useful. I never knew that explicitly stating dual intent in a letter along with twp would help. I guess it is pretty often the case with temp workers specially if they are in skilled categories.

Thank you for your clear information and for sharing your experience.

I am applying for a Worm Picker (Farm Worker) NOC 8431.

According to the Employer, there is no such a program for my position to get a PR in Ontario province right now. Those programs are applied for other provinces.

In that case, I should try another way. I will write a cover letter to convince the officer that i will come back to my country in the end of the contract. I will tell that i have my parents, wife, and son that stay in my hometown and waiting for me to come back after my contract finished. I will attach our family certificate along with it. Is there thing else you think can proof my intention?

Why dont you even proof your ( property.) Farming land.

I added family pictures to my application before. Including my cousins and everyone in the family. Family reunion pictures, vacations with families and stuff like that.

Yes, attach the copies of your family certificate, marriage certificate, (and maybe your son's birth certificate), and if you own a house or a piece of farm land, or any transportation such as motorcycle under your name, attach the certificates. If you have savings in a bank under your name, attach the copy of the bank statement.
List/write all the certificates you attach in your cover letter. Does the visa office there ask a visa applicant to translate the documents if they are not written in English?
