Police Clearance issue, please advise

Hello Friends,

I lived in China for about two years. I'm trying to get the PCC from Beijing, China with the help of my friend who is currently in Beijing. Today I received a call from him and he told me that he went to apply for my PCC, but the officials have refused to accept my application.

He told me that initially, everything went well and he handed over the application along with my passport copies. But when the official saw the passport type and the type of visa stamped on passport, he refused to accept the application. The official said that as my passport was an Official passport, he cannot accept the application. They are only authorized to issue PCC for ordinary passports.

Now the problem is that currently I have an ordinary passport, but the duration for which I lived in Beijing, I had an official passport and the reason of stay in Beijing was an official training. So my passport was official passport and all the visa related things were handled by my government. I had no clue about the type of visa or anything related, at all..

Please guide me guyz, what can I do in this situation? I've seen on this forum that the number 1 reason for PR application rejection is non availability of PCC. What can I do in this situation. Please help.

You don't need to get your PCC on your earlier held passport. PCCs whenever you apply for are applied based on the current passport that you hold. So get your PCC on your currently held (Ordinary) passport itself.

I really don't think so. Because all my Chinese visas are on my old passport. In the documents requirement, they have specifically mentioned that I need to submit the copies of all pages which have Chinese entry/exit stamps and visas. My new passport has no visa stamped on it :(

They are not wrong in asking for the passport (Old) as that has the Chinese entry/exit stamps and visas. They definitely need to verify that before they issue you the required PCC to exactly know since when you were first and till when you were last in China, but that doesn't mean that you can do away without providing them with your current passport.

PCCs are always stamped on the passport that is/was current on the date the PCC is/was issued. Period.

So you decide what you need to do.

I think you guyz are not understanding the issue.

The Chinese authority which issues PCC says that as I had OFFICIAL passport while I lived in China, so they cannot issue me PCC. The issue is not at my end. I've can give them all copies of my old and current passport.

Now the thing is that, they are not issuing me PCC and CIC requires that I must submit a PCC for every country where I've lived for more than 6 months.

If I tell CIC about this situation, what kind of proof should I give them that Chinese authorities are not issuing me PCC because I had official passport?

Has anyone gone through similar situation?

Please advise

I guess you either need to give a self declared consent to the chinese police to release your information/document to your friend or you have to involve your embassy/counsalate to get you the cert.

There are a number of circumstances where people are truly are unable to obtain the PCCs; if they provide a letter of explanation and documentation to support their claim, CIC will usually waive the requirement. Most people who are refused because of PCCs either completely fail to understand that they need to provide one, or don't provide the explanation or documentation.

In your case, the following provides support to your claim that Chinese authorities do not provide PCCs if you were in China on an official passport -

"Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories. Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations."

So, where you are asked to upload a PCC for China, provide a letter of explanation. Explain the dates you were in China, where you lived (address(es)), and what you were doing there (where you were training). Explain everything you did to try to get the PCC. If you can get your friend to put his story in writing (e.g. an email from your friend about what happened), that will help. You can provide the information I pasted above. It would be better if you could get information from an official Chinese source, but good luck with that. Include photocopies of the official passport and Chinese visa stamps. Since you were on an official passport, I would guess you have something official from your country documenting the purpose of your trip to China. Provide that (with a translation if necessary).

Then, request guidance on how to get a PCC for an official passport holder, or alternatively a waiver of the requirement.

Unfortunately, CIC will not give you a response, you just have to wait and see if your application is approved. But this does happen to a lot of people.
